τις διατάξεις της Συμφωνίας για τη ρύθμιση της οδικής διακίνησης επιβατών και εμπορευμάτων μεταξύ των δύο χωρών καθώς και της διέλευσης τράνζιτ μεταξύ των εδαφών τους, που υπογράφηκε στην Αθήνα στις 9 Ιουλίου 1964 και κυρώθηκε με το ν.δ. 4393/1964, που δημοσιεύθηκε στο 193 Φύλλο Εφημερίδος της Κυβερνήσεως τεύχος Α, της 4.11.1964.

τις διατάξεις του άρθρου 90 για την «Κωδικοποίηση της νομοθεσίας για την Κυβέρνηση και τα κυβερνητικά όργανα» (π.δ. 63/ΦΕΚ 98/Α/22.4.2005).

το γεγονός ότι εκ του περιεχομένου του υπό έγκριση Πρωτοκόλλου δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.

το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολο του το Πρωτόκολλο της Συνόδου της Μικτής Ελληνο−Βουλγαρικής Επιτροπής Οδικών Μεταφορών που υπογράφηκε στην Αθήνα στις 7 Ιουλίου 2005 το κείμενο του οποίου σε πρωτότυπο στην αγγλική και σε μετάφραση στην ελληνική γλώσσα έχει ως εξής: PROTOCOL OF THE MEETING OF THE JOINT BULGARIAN−HELLENIC COMMITTEE ON ROAD TRANSPORT Athens, 6 – 7 / 7 / 2005 The Meeting of the Joint Bulgarian – Hellenic Transport Committee on Road Transport was held in Athens, on 6 – 7 July 2005. The Hellenic Delegation was h eaded by Mr. Vassilios Kallivokas, General Director in the Ministry of Transport and Communications of the Hellenic Republic. The Bulgarian Delegation was headed by Mr. Nikolay Tochev, Executive Director of Road Transport Administration Executive Agency in the Ministry of Transport & Communications of the Republic of Bulgaria. The lists of the Bulgarian and Hellenic Delegations are attached as Annex I and II to this Protocol. The following agenda was agreed by the delegations:

Miscellaneous With a view of further enhancing the Bulgarian – Hellenic mutual cooperation in the transport field, the two Sides held fruitful discussions on all issues of common interest and reached the following conclusions:

Road Transport of Goods The two Sides exchanged information regarding the recently performed bilateral and transit road transport of goods, between and through their territories. Both Sides underlined the high level of cooperation between the two countries within the framework of SECI, ECMT and E.U. The Bulgarian side requested an increase in the current quota of a hundred and fifty (150) annually exchanged permits from third countries. The Greek Side, in response, stated that apart from the currently standing quota of bilaterally exchanged permits, this type of transport is sufficiently carried out with the use of the existing quota of ECMT permits (155 permits for Bulgaria each one valid for fifty journeys). Therefore the Greek Side cannot consent to such proposal. The Greek Side noted that the Greek hauliers while operating within the Bulgarian territory face the following problems: a. Restrictions, in certain roads of the Bulgarian territory, in the maximum permissible weight of trucks comparing to the relevant provisions of directive 96/53/EC. b. Discrimination regime in the charging for the use of road infrastructure among Bulgarian and Greek hauliers. c. Delays in border crossings. The Bulgarian Side noted in response the following: a. The directive 96/53/EC is applied in Bulgaria with some exceptions. However the Bulgarian Side is ready to provide the Greek Side with a detailed map indicating the maximum permissible axle loading of trucks in major roads of the Bulgarian territory. increasing and decreasing respectively for Bulgarian and foreign hauliers, until becoming equal for all, as from January 1st 2007. c. Delays really exist at the border crossing point between Greece and Bulgaria and both Sides should take further actions to improve the situation. Both Sides agreed that the permits exchanged each year for transportation of goods from third countries should be valid until the 31st of January of the following year. In this light both Sides undertook to inform their border authorities respectively. Both Sides agreed to invite their respective border authorities to stamp the book of ECMT permits in order to facilitate the control of freight transport operation with the use of ECMT permits.

Road Transport of Passengers The two Sides presented the current situation in the field of the regular transport of passengers. The Greek Side noted that a transport operator should not conclude a contract prior to the application for the operation of an international regular bus line. Moreover the cooperation between transport operators of both Sides, holders of authorizations for the operation of regular bus lines should not be obligatory. Thus a transport operator resident in one Contracting Party in order to operate regular bus lines should have the possibility either to cooperate with a transport operator of the other Contracting Party operating the same regular line or to set up an office in the country of destination with respect to the legislation of this country. The Bulgarian Side informed the Greek Side that the Bulgarian legislation provides only for operation on international regular bus lines by a Bulgarian transport operator in cooperation with a partner from the other Contracting Party on the basis of reciprocity and mutual exploitation of the lines. The Greek Side proposed either the liberalisation of the operation of regular bus lines between the two countries or the increase in the total number of the corresponding itineraries. In this light the Greek Side considers that each transport operator of both countries should operate as many weekly itineraries in every regular line as he wishes. The Bulgarian Side stated in response that the increase of the weekly itineraries could take effect only upon agreement between the partners already operating the regular bus line. The Greek Side stated that due to a recent reform of the Greek legislation, the number of Greek transport operators operating each regular bus line would not be limited. However the agreed total number of weekly itineraries allocated to transport operators of each Side would be maintained as is. The Bulgarian Side informed the Greek Side that the Bulgarian transport operators authorised to operate the existing regular bus lines are as follows: − “Eurolines – Bulgaria Eurobus” − “MATPU 96” OOD − “MTT – Sofia” − “Tourist Service” AD − Todorka Eneva − Doris Moreover the Bulgarian Side added that each new Greek transport operator proposed by the Greek Ministry of Transport & Communications to operate the existing regular bus lines would have to sign a contract for mutual exploitation of the line following the adopted rules with the corresponding Bulgarian transport operator on the same line including the number of itineraries which would not exceed the number of fifteen per month for each transport operator (following an operational scheme 3:4, 4:3 weekly − 1st week 3 itineraries for the Bulgarian operator and 4 for the Greek operators, the following week 4 itineraries for the Bulgarian operator and 3 for the Greek operators and so on). The Greek Side could not consent to such standpoint as the total number of itineraries for each regular line is fixed and already mutually agreed. The Bulgarian Side informed the Greek Side that it has not received the full set of documents in annex to the authorisations for the continuation of operation of the existing bus lines, duly stamped and signed by both partners i.e. the itineraries, route timetable, price list and route map. The Greek Side stated in response that it would provide the Bulgarian Side with the requested set of documents, according to the procedure that was previously followed for the issuing of authorisations, until the end of July 2005. Both Sides agreed that correspondence between the Ministries of both countries should be carried out both through ordinary diplomatic channels and by fax in order to avoid delays.

Miscellaneous The Greek Side following a question posed by Bulgarian Side stated that the Bulgarian taxi drivers, as the Greek legislation provides for all foreign taxi drivers, in order to cross the Greek borders should present certain documents, namely: a. A translated copy, validated by the Greek Consulate, of the registration documents of the taxi which clearly indicate that the vehicle is used for on hire transportation of passengers. b. A detailed list of passengers inclusive of their passport numbers. The two Sides underlined their satisfaction for the constant improvement of bilateral road transportation as well as for the level of cooperation achieved. The Meeting of the Joint Bulgarian – Hellenic Transport Committee was held in a friendly atmosphere depending upon mutual understanding and fruitful cooperation. The Bulgarian Side invited the Greek Side in Sofia for the next Meeting of the Joint Bulgarian – Hellenic Transport Committee. This Protocol was done in Athens on the 7th of July 2005 in two original copies in the English language. Venelin Vandov Councellor ΕΠΙΤΡΟΠΗΣ ΟΔΙΚΩΝ ΜΕΤΑΦΟΡΩΝ Αθήνα 6 − 7.7.2005 Η Σύνοδος της Μικτής Ελληνο−Βουλγαρικής Επιτροπής Μεταφορών για τις Οδικές Μεταφορές έλαβε χώρα στην Αθήνα την 6η και 7η Ιουλίου 2005. Η Ελληνική Αντιπροσωπεία είχε επικεφαλής τον κύριο ΒΑΣΙΛΕΙΟ ΚΑΛΛΙΒΩΚΑ, Γενικό Διευθυντή του Υπουργείου Μεταφορών και Επικοινωνιών της Ελληνικής Δημοκρατίας. Η Βουλγαρική Αντιπροσωπεία είχε επικεφαλής τον Nikolay Tochev, Γενικό Διευθυντή Οδικών Μεταφορών του Υπουργείου Μεταφορών και Επικοινωνιών της Δημοκρατίας της Βουλγαρίας. Ο κατάλογος των μελών της Ελληνικής και της Βουλγαρικής Αντιπροσωπείας επισυνάπτεται ως Παραρτήματα Ι και ΙΙ στο παρόν Πρωτόκολλο. Συμφωνήθηκε από τις αντιπροσωπείες η ακόλουθη ημερήσια διάταξη:

Διάφορα Θέματα Με προοπτική την περαιτέρω επαύξηση της ΕλληνοΒουλγαρικής αμοιβαίας συνεργασίας στον τομέα των μεταφορών, οι δύο Πλευρές διεξήγαγαν καρποφόρες συζητήσεις επί όλων των θεμάτων κοινού ενδιαφέροντος και κατέληξαν στα ακόλουθα συμπεράσματα:

Οδικές Μεταφορές Εμπορευμάτων Οι δύο Πλευρές αντάλλαξαν πληροφορίες αναφορικά με τις προσφάτως εκτελεσθείσες διμερείς μεταφορές και μεταφορές διέλευσης (transit) εμπορευμάτων μεταξύ και μέσω των εδαφικών τους περιοχών. Αμφότερες οι πλευρές υπεγράμμισαν το υψηλό επίπεδο συνεργασίας μεταξύ των δύο χωρών μέσα στο πλαίσιο της Πρωτοβουλίας για Συνεργασία στην ΝοτιοΑνατολική Ευρώπη (SECI), της Ευρωπαϊκής Διάσκεψης των Υπουργών Μεταφορών (ΕΔΥΜ) και της Ευρωπαϊκής Ένωσης (ΕΕ). Η Βουλγαρική Πλευρά ζήτησε αύξηση της υφιστάμενης ποσόστωσης των εκατών πενήντα (150) ετησίως ανταλλασσομένων αδειών από τρίτες χώρες. Η Ελληνική Πλευρά, σε απάντηση, δήλωσε ότι, εκτός από τις ισχύουσες την στιγμή αυτή αναλογίες διμερώς ανταλλασσομένων αδειών, ο τύπος αυτών των μεταφορών διενεργείται επαρκώς με την χρήση των υφισταμένων αναλογιών των αδειών της ΕΔΥΜ (150 άδειες για την Βουλγαρία που η κάθε μία ισχύει για 50 ταξίδια). Επομένως η Ελληνική Πλευρά δεν μπορεί να συμφωνήσει με αυτήν την πρόταση. Η Ελληνική Πλευρά σημείωσε ότι οι Έλληνες μεταφορείς ενώ λειτουργούν μέσα στην Βουλγαρική επικράτεια αντιμετωπίζουν τα ακόλουθα προβλήματα: α. Περιορισμοί, σε ορισμένους δρόμους της Βουλγαρικής επικράτειας, ως προς το μέγιστο επιτρεπόμενο βάρος των φορτηγών σε σύγκριση με τις σχετικές διατάξεις της Οδηγίας 96/53/ΕΚ. β. Καθεστώς διακρίσεων ως προς την χρέωση για την χρησιμοποίηση της οδικής υποδομής ανάμεσα σε Βούλγαρους και Έλληνες μεταφορείς. γ. Καθυστερήσεις κατά τις συνοριακές διελεύσεις. Η Βουλγαρική Πλευρά σε απάντηση για τα παραπάνω παρατήρησε τα ακόλουθα: α. Η Οδηγία 96/53/ΕΚ εφαρμόζεται στην Βουλγαρία με κάποιες εξαιρέσεις. Όμως η Βουλγαρική Πλευρά είναι έτοιμη να παράσχει στην Ελληνική Πλευρά λεπτομερή χάρτη όπου θα εμφανίζεται το μέγιστο επιτρεπόμενο φορτίο ανά άξονα για τα φορτηγά στους σημαντικότερους δρόμους της Βουλγαρικής επικράτειας. β. Σύμφωνα με την μεταβατική περίοδο η οποία απετέλεσε αντικείμενο διαπραγμάτευσης με την Ευρωπαϊκή Ένωση η τιμή του ειδικού σήματος (vignette) θα μεταβληθεί βαθμηδόν, αυξανόμενη και μειούμενη αντίστοιχα για τους Βούλγαρους και ξένους μεταφορείς, μέχρις ότου καταστεί ίση για όλους από 1ης Ιανουαρίου 2007. γ. Καθυστερήσεις υφίστανται στην πραγματικότητα στο σημείο συνοριακής διέλευσης μεταξύ Ελλάδος και Βουλγαρίας και αμφότερες οι Πλευρές θα πρέπει να προβούν σε περαιτέρω ενέργειες για την βελτίωση της κατάστασης. Και οι δύο Πλευρές συμφώνησαν ότι οι άδειες οι οποίες ανταλλάσσονται κάθε χρόνο για την μεταφορά εμπορευμάτων από τρίτες χώρες θα πρέπει να ισχύουν μέχρι την 31η Ιανουαρίου του επομένου έτους. Μέσα σε αυτό το πλαίσιο και οι δύο πλευρές ανέλαβαν την υποχρέωση να ενημερώσουν αντιστοίχως τις συνοριακές τους αρχές. Και οι δύο Πλευρές συμφώνησαν να καλέσουν τις αντίστοιχες συνοριακές τους αρχές να σφραγίζουν το βιβλίο των αδειών ΕΔΥΜ για να διευκολυνθεί ο έλεγχος της λειτουργίας των εμπορευματικών μεταφορών με την χρήση των αδειών ΕΔΥΜ.
