The Health and Personal Social Services (Quality, Improvement and Regulation) (2003 Order) (Commencement No. 2) Order (Northern Ireland) 2003

The Department of Health, Social Services and Public Safety, in exercise of the powers conferred on it by Article 1(3) of the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003[^f00001], and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation

This Order may be cited as the Health and Personal Social Services (Quality, Improvement and Regulation) (2003 Order) (Commencement No. 2) Order (Northern Ireland) 2003.

Appointed day

2

1st September 2003 is the appointed day for the coming into operation of the following provisions of the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003 –

• (a) Article 3 and Schedule 1 (the Health and Social Care Regulation and Quality Improvement Authority );

• (b) Article 6 (Regulations and directions);

• (c) Article 38 (1), (2) and (3) (Statements of minimum standards);

• (d) Article 48 (Regulations, orders and directions) and

• (e) Article 50 (1) and Schedule 4 in so far as they relate to amendments to the Superannuation (Northern Ireland) Order 1972[^f00002] and the Northern Ireland Assembly Disqualification Act 1975[^f00003].

Explanatory note

(This note is not part of the Order.)

This Order brings into operation on 1st September 2003 further provisions of the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003.

Article 2 sets out the provisions of the Order which are to come into operation on 1st September 2003.

These include establishment of the Health and Personal Social Services Regulation and Improvement Authority as a body corporate; powers to make regulations and directions related to the exercise of the functions of the Health and Personal Social Services Regulation and Improvement Authority; provisions for preparation, publication, review of, and consultation on statements of minimum standards, and certain related amendments to other legislation.
