Coming into operation: 1st January 2012

The Department of Agriculture and Rural Development makes the following Order in exercise of the powers conferred on it by Article 8(1), (2) and (5) of the Diseases of Animals (Northern Ireland) Order 1981[^f00004] and section 2(2) of, as read with paragraph 1A of Schedule 2 to, the European Communities Act 1972 having consulted with bodies which appeared to it to be substantially representative of the interests concerned and with the approval of the Department of Finance and Personnel.

Citation and commencement

This Order may be cited as the Northern Ireland Poultry Health Assurance Scheme Order (Northern Ireland) 2011 and shall come into operation on 1st January 2012.

The Northern Ireland Poultry Health Assurance Scheme

For the purposes of approving and monitoring poultry establishments engaging in trade with Member States of poultry and hatching eggs as required by Article 6 of, and Annex II to, Council Directive 2009/158/EC (on animal conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs) the Department hereby makes the Scheme set out in the Schedule.

PART I — INTRODUCTION

For the purposes of this Schedule—

The Department is the competent authority for the purposes of the Directive.

Any approval granted or notice issued by the Department under this Order—

and to do so is an offence under regulation 5(1) of the Trade in Animals and Related Products Regulations (Northern Ireland) 2011[^f00005].

Membership

On acceptance of membership to the Northern Ireland Poultry Health Assurance Scheme the Department shall issue the establishment’s membership certificate which shall include the establishment’s membership number.

The operator of an establishment that is a member of the Northern Ireland Poultry Health Assurance Scheme shall pay the annual membership fee each year and shall pay any re-inspection fee, when it becomes due.

a veterinary inspector directly employed by the Department shall carry out such re-inspections as the Department considers necessary to ensure compliance on the part of that operator and his establishment with those requirements.

Designation of laboratories

The Department may, by notice, suspend or revoke a designation granted to a laboratory under paragraph 13 where—

The Department may, by notice, end a suspension of a designation imposed under paragraph 14 if it is satisfied that the laboratory concerned has taken adequate measures to enable it to fulfil the conditions of the designation.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order provides a statutory basis for the Northern Ireland Poultry Health Assurance Scheme.

The Scheme is a means of approving and monitoring poultry establishments engaging in intra-Community trade of poultry and hatching eggs. The approval and monitoring of such establishments is a requirement of Council Directive 2009/158/EC. The Directive prohibits exports unless the commodities originate from an establishment that is a member of the Northern Ireland Poultry Health Assurance Scheme and conforms to the requirements of Directive 2009/158/EC. It also provides for powers for suspension or revocation of membership under specified circumstances.

A full impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
