The Secretary of State for the Environment and the Minister of Agriculture, Fisheries and Food, acting jointly as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred by section 97 of the Environment Act 1995[^f00001], and of all other powers enabling them in that behalf, having undertaken the consultations required by section 97(6) of that Act, hereby make the following Regulations, a draft of which has been laid before, and has been approved by resolution of, both Houses of Parliament:

Citation and commencement

These Regulations may be cited as the Hedgerows Regulations 1997 and shall come into force on 1st June 1997.

shall be treated as part of the hedgerow.

Criteria for determining “important” hedgerows

For the purposes of section 97 (hedgerows) of the Environment Act 1995 and these Regulations, a hedgerow is “important” if it, or the hedgerow of which it is a stretch,—

as if it were an “important” hedgerow within the meaning of regulation 4.

and he shall notify the appellant and the local planning authority of his determination of the appeal.
