Coming into force: 31st July 2005

Whereas a draft of these Regulations has been approved by resolution of each House of Parliament, pursuant to section 19(3) of the Tobacco Advertising and Promotion Act 2002 ;

Now, therefore, the Secretary of State, in exercise of the powers conferred by sections 11 and 19(2) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Tobacco Advertising and Promotion (Brandsharing) Regulations 2004 and shall come into force on 31st July 2005.

THE SCHEDULE — HEALTH WARNINGS AND HEALTH INFORMATION

An advertisement to which this Schedule applies shall include an area which is not less than 30% of the total surface area of the advertisement in which is displayed, in accordance with the requirements specified in paragraph 2, the health warning “Smoking kills” or the health warning “Smoking seriously harms you and others around you” and the following information—
