The National Assembly for Wales makes the following Regulations in exercise of the powers given to the Secretary of State by section 79 (2) and (3) of the Housing Grants, Construction and Regeneration Act 1996[^f00001], which are now vested in it[^f00002], and of all other powers enabling it in that behalf:

Extension of home repair assistance

The availability of home repair assistance shall be extended by treating income-based jobseeker’s allowance[^f00003] as one of the benefits listed in subsection (1)(e) of section 77 (entitlement to home repair assistance) of the Housing Grants, Construction and Regeneration Act 1996.

Explanatory note

(This note is not part of the Regulations)

Under the Housing Grants, Construction and Regeneration Act 1996 a local housing authority may provide home repair assistance in the form of a grant or the provision of materials for the carrying out of works of repair, improvement or adaptation to a dwelling.

For entitlement to home repair assistance a local housing authority has to be satisfied that the conditions set out in section 77(1) of the Act apply. These include the condition that the applicant or the applicant’s partner is in receipt of a benefit listed in subsection (1)(e).

These Regulations enable income-based jobseeker’s allowance to be treated as a benefit within that subsection.

These Regulations extend to Wales only.
