The Welsh Ministers, in exercise of the powers conferred upon the Secretary of State by sections 22 and 42(6) of the Teaching and Higher Education Act 1998[^f00001], and now exercisable by them[^f00002] make the following Regulations:

The Education (Student Support) (Wales) Regulations 2015[^f00003] are amended in accordance with the following regulations.

In regulation 3(15) (revocation, savings and transitional provisions) for “2014”, in each place it appears in that paragraph, substitute “2015”.

In regulation 10(2)(b) (time limits) for the words “regulation 21(4)” substitute “regulation 21(7)”.

In Schedule 5 (financial assessment)—

In paragraph 4(3) of Schedule 6 (financial assessment – part-time grants for dependants) after the words in quotation marks but before the closing bracket insert the words “in this paragraph”.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

The Education (Student Support) (Wales) Regulations 2015 (“the 2015 Regulations”) provide for financial support for students who are ordinarily resident in Wales and taking designated higher education courses in respect of academic years beginning on or after 1 September 2015.

Regulation 3 amends regulation 3(15) of the 2015 Regulations.

Regulation 4 updates a cross reference in regulation 10(2)(b) of the 2015 Regulations.

Regulation 5 makes amendments to paragraphs 2, 4 and 6 of Schedule 5 to the 2015 Regulations.

Regulation 6 adds words of clarification to paragraph 4 of Schedule 6 to the 2015 Regulations.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

[^f00002]: The functions of the Secretary of State under section 22 of the Teaching and Higher Education Act 1998 (except so far as they relate to the making of any provision authorised by subsection (2)(a), (c), (j) or (k), (3)(e) or (f) or (5) of section 22) were transferred to the National Assembly for Wales by section 44 of the Higher Education Act 2004 and the Higher Education Act 2004 (Commencement No. 2 and Transitional Provision) (Wales) Order 2005 (S.I. 2005/1833 (W. 149) (C. 79)) as amended by the Higher Education Act 2004 (Commencement No. 2 and Transitional Provision) (Wales) (Amendment) Order 2006 (S.I. 2006/1660 (W. 159) (C. 56)). The functions of the National Assembly for Wales were transferred to the Welsh Ministers by virtue of paragraphs 30(1) and 30(2)(c) of Schedule 11 to the Government of Wales Act 2006 (c. 32).
