Τις διατάξεις της Συμφωνίας οικονομικής, βιομηχανικής, επιστημονικής και τεχνικής συνεργασίας μεταξύ των Κυβερνήσεων της Ελληνικής Δημοκρατίας και της Ουκρανίας μετά των συνημμένων επιστολών, που υπογράφηκε στην Αθήνα, στις 15 Ιανουαρίου 1992 και κυρώθηκε με το ν. 2142/1993, που δημοσιεύθηκε στο υπ’ αριθμ. 86 Φύλλο Εφημερίδος της Κυβερνήσεως, Τεύχος Α΄ της 28ης Μαΐου 1993.

Το άρθρο δεύτερο του ως άνω κυρωτικού νόμου σύμφωνα με το οποίο τα Πρωτόκολλα–Πρακτικά που συντάσσονται βάσει του άρθρου 10 της Συμφωνίας από τη Μικτή Ομάδα Εργασίας θα εγκρίνονται από τους αρμόδιους κατά περίπτωση Υπουργούς.

Τις διατάξεις του άρθρου 90 της Κωδικοποίησης της νομοθεσίας για την Κυβέρνηση και τα Κυβερνητικά όργανα (π.δ. 63 − ΦΕΚ 98/Α/22.4.2005).

Το γεγονός ότι από την εφαρμογή των διατάξεων του υπό έγκριση Πρωτοκόλλου δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που έχει εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.

Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της 5ης Συνόδου της Μικτής Διακυβερνητικής Επιτροπής για την οικονομική, βιομηχανική, επιστημονική και τεχνολογική συνεργασία μεταξύ της Ελληνικής Δημοκρατίας και της Ουκρανίας που υπογράφηκε στην Αθήνα, στις 13 Ιουλίου 2011, το κείμενο του οποίου σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: 1009 SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE HELLENIC REPUBLIC AND UKRAINE (Athens, July 13, 2011) The 5th Session of the Joint Intergovernmental Committee on Economic, Industrial, Scientific and Technological Cooperation between the Hellenic Republic and Ukraine was held in Athens, on July 13, 2011, in accordance with the provisions of the Agreement on Economic, Industrial, Scientific and Technological Cooperation, signed between the two countries in Athens, on January 15, 1992. Deputy Minister for Foreign Affairs, Demetri Dollis, headed the Hellenic Delegation. Deputy Minister for Infrastructure, Volodymyr Korniienko, headed the Ukrainian Delegation. The Lists of Participants of both delegations and the Agenda of the Session are attached to this Protocol, as Annexes I and II, respectively. During the meeting of the Joint Intergovernmental Committee on Economic, Industrial, Scientific and Technological Cooperation, which was conducted in an atmosphere of mutual understanding and traditional friendship, both Sides, presented an overview of current developments in the economies of their countries and reviewed their bilateral economic and commercial relations, since the 4th Session of the Committee, held in Kiev, on June 7-8, 2006. Both Sides stated their readiness to take all necessary measures, in order to improve the bilateral relations, on the basis of mutual interest. The following conclusions resume the works of this Session:

BILATERAL ECONOMIC AND TRADE COOPERATION Both Sides exchanged information regarding economic development in their respective countries, as well as regarding measures of economic policy, which may ease and strengthen the enhancement of their bilateral trade and economic cooperation. The Ukrainian Side expressed the intention to take part in the Thessaloniki International Fair, organized by Helexpo every September. The Ukrainian Chambers of Commerce, Organizations, Associations and Individual Firms shall encourage their member-companies to take part in the various specialized trade shows of Helexpo, as well as in the business-to-business meetings of the Expopartenariat programme of each sector exhibition. measures, publications and public events on leading investment measures of common interest (such as fora, seminars, exhibitions and round tables) on a regular basis as well as to facilitate the participation of business persons of both countries in such events. The Ukrainian Side expressed interest in signing the Memorandum of Understanding and Cooperation between the State Investment Agency of the Hellenic Republic "Invest in Greece" and the State Agency of Ukraine for Investment and Development. Both Sides welcomed the willingness of the political leadership of the EU and Ukraine to conclude negotiations on the creation of the Deep and Comprehensive Free Trade Area between the EU and Ukraine until 2011. Such timely conclusion of the Agreement would greatly contribute towards the solution of existing problems in bilateral trade, such as non-tariff barriers, customs delays, standardization issues etc. The Hellenic Side stressed the importance of facilitation of customs procedures so that the bilateral trade can grow substantially. Both Sides stated that further development of economic relations constitute a mutual interest of both countries: - promoting the export of agricultural products known for their quality (for instance, Hellenic fresh and canned peaches, Ukrainian wheat); - encouraging companies to participate to fairs and exhibitions held in both countries; - enhancing cooperation between the Chambers of Commerce and Industry, the business Associations and other business organizations for further expansion of links between the companies of both Sides; - exploring new opportunities of cooperation in fields such as constructions, renewable energy sources, office and home furniture, know-how transfer in agriculture and food industry; - attracting mutual investments of Hellenic and Ukrainian companies in sectors of common interest such as tourism; - promoting cooperation between regions of both countries. of the visit of the President of Ukraine Viktor Yanukovych to the Hellenic Republic. The Hellenic Side noted that the Hellenic Foreign Trade Board (HEPO) will organize a business mission to Ukraine (Kiev and Odessa) in September 2011.

ENHANCING COOPERATION IN PRIORITY SECTORS 2.1. Energy The Hellenic Side noted the strategic importance of Ukraine’s role as a transit state and welcomed the membership of Ukraine to the Energy Community as a major step that will enhance security of supply and strengthen energy cooperation amongst the regional partners, in order to establish an integrated market in natural gas and electricity based on the principles of the EU’s internal market, and ensure for the citizens of all Parties access to stable gas and electricity supply. In this context, both Sides agreed to increase and strengthen cooperation amongst the Ministries responsible for energy and between the Centre for Renewable Energy Sources and Saving (CRES) and the State Agency on Energy Efficiency and Energy Saving of Ukraine (Ex NAER) with a view to organizing seminars on knowledge-transfer regarding the development and implementation of the EU’s acquis communautaire on energy, including policies for renewables and energy efficiency measures. The participation and contribution of the Greek National Regulatory Authority in the Twinning Project “Regulatory and Legal Capacity Strengthening of Natural Gas Regulation in NERC” was duly noted. The Hellenic Side confirmed its interest in the prospect of electricity imports from Ukraine on the basis of a transparent regulatory framework in accordance with the acquis communautaire. Both Sides agreed to consider the possibility of importing electricity from Ukraine. Both Sides agreed that addressing the negative consequences of climate change by increasing the share of renewables in their energy mix and expanding energy efficiency measures constitutes a priority. In this respect, they will examine ways to promote jointly programs for energy efficiency in buildings and technology transfers in renewables and encourage, to this end, the involvement of the private sector and further cooperation between the Centre for Renewable Energy Sources and Saving of Greece and the State Agency on Energy Efficiency and Energy Saving of Ukraine. Both Sides stated that they are interested in the prospect of electricity imports from Ukraine and will support all efforts to render such imports feasible from the technical, economic and political viewpoint. environmental protection. The Hellenic Side stated their readiness to provide know-how in the field of fighting pollution caused in natural and marine environment. 2.3. Transport Road Freight and Passenger Transport The two Sides expressed their satisfaction for the overall level of cooperation on issues of road freight and passenger transport. The two Sides exchanged the information about the establishment of quota on bilateral and transit road transportations between the Hellenic Republic and Ukraine. The two Sides confirmed their mutual efforts concerning the development of passenger transportations on a base of reciprocity and parity. The Hellenic Side also stated the submission of reports by Greek hauliers that indicate problems in the passage of the territory of Ukraine during the customs procedures. The Hellenic Side noted their standpoint that there should be a further liberalization in the regular passenger transportation between the two countries. Both Sides agreed to discuss the above mentioned issues in the framework of the next meeting of the Joint Committee on Road Transport to be held in Kyiv in September 2011. Air Transport Both Sides expressed their satisfaction about the signing of the new Air Transport Agreement in the near future, which will without doubt contribute to further enhancing bilateral cooperation in the air transport sector. Maritime Transport Both Sides underlined their willingness to develop more intensively and expand their cooperation in the shipping sector on the basis of the existing Agreement on Merchant Shipping (2000). Both Sides also agreed to cooperate towards the facilitation of seafarers and the protection of the seafaring profession. Ukrainian ports based upon stable and frequent transport flows. To this end, both Sides confirmed their interest in cooperating further within the framework of the Black Sea Economic Cooperation (BSEC), as well as their intention to promote the development of Motorways of the Seas (MoS) in the Black Sea Region. Also, both Sides reconfirmed their interest towards the promotion of cooperation in the port sector. In particular, both Sides agreed to examine the possibility to establish a maritime line between Piraeus (Hellenic Republic) and Odessa (Ukraine) or between other ports, provided their viability. 2.4. Shipbuilding In the shipbuilding sector, there is ongoing cooperation. As many Greek ships are currently under maintenance and repair in Ukrainian shipyards, both Sides agreed to enhance further their cooperation in this sector. The Ukrainian Side expressed interest in placing orders by Greek ship-owners for the construction of ships at the Ukrainian shipbuilding yards and informed the Greek Side on the possibilities of actual placement of orders for building ships at the Ukrainian shipyards. The Ukrainian Side is ready to provide the required information regarding the abovementioned as well as to organize visits to the Ukrainian shipyards. Both Sides referred to the project in Ilyichevsk port concerning the construction of a building-refrigerated storage unit for perishable goods, undertaken by a Hellenic company. 2.5. Agriculture Both Sides, judging that the Agreement for Economic, Scientific and Technical Cooperation in the field of Agriculture between them provides the possibility for intensification of the bilateral cooperation in a wide range of relative fields, expressed their intention to activate it in the most effective way for their mutual benefit. Regarding their bilateral trade in agricultural and food products, both Sides agreed to make every effort to enhance it further and to eliminate potential technical barriers to trade, as well as to encourage promotion initiatives in both Sides. Both Sides agreed on the importance of the protection of geographical indications of agricultural and food products in upholding rural economies and in protecting consumers from imitations. state bodies by improving communication, consultation and exchange of information. The Ukrainian Side expressed interest in the participation of Greek companies in the joint production of agricultural and food products, establishing business contacts between Greek and Ukrainian colleagues to exchange information and explore possibilities for cooperation. Both Sides agreed to consider the possibility of cooperation between scientific and educational agrarian institutions. Both Sides discussed the possibility of participation of Greek and Ukrainian companies in exhibitions and fairs in both countries. 2.6. Constructions The Hellenic Side expressed the interest of Hellenic construction companies in undertaking infrastructure projects in Ukraine. The Hellenic Side also noted their readiness to provide know-how and logistics services on staff management, volunteers and athletic games organisation, especially in view of UEFA EURO 2012. 2.7. Communication and Information Technology Both Sides expressed their intention to conclude ratification procedure in order for the Agreement on cooperation in the Fields of Posts and Telecommunications, signed in Athens, on December 1, 2009, to enter into force. 2.8. Tourism Both Sides attribute great importance to further developing their bilateral relations in the field of tourism. To this end, they reiterated their willingness to encourage the cooperation between the associations of travel agencies of both countries and examine the possibilities of promoting their cooperation through the exchange of know - how in the field of Special Interest Tourism, such as, among others, cultural tourism, religious tourism and sports tourism. More specifically, acknowledging the fact that cruise tourism is an excellent tool for countries to highlight, diversify and enrich their tourist products and upgrade their services, both Sides view positively the potential development of cruise itineraries between Greece and Ukraine. In this context, both Sides agreed to encourage their National Tourism Administrations to convene the Joint Committee provided for in the Agreement on 2.9. Standardization and Certification In connection with the expiration of the Agreement on Cooperation between the Hellenic Organization for Standardization and the State Committee of Ukraine on Technical Regulation and Consumer Policy in the field of Standardization and Conformity Assessment in December 2011, both Sides have examined the possibility of signing a new Memorandum of Understanding in the abovementioned fields between the respective national bodies of both countries. 2.10. Consumer Rights Protection Both Sides expressed their interest to sign an interagency Memorandum in the field of consumer rights protection between the authorized national Greek and Ukrainian bodies. 2.11. Small and Medium Sized Enterprises and Entrepreneurship Taking into consideration the role of Small and Medium Sized Enterprises (SMEs) in the development of each national economy, in increasing the population’s living standards and in providing social and political stability, both Sides expressed their satisfaction regarding the existing cooperation, at bilateral and multilateral level, between the Hellenic Organization of Small and Medium Sized Enterprises and Handicraft (EOMMEX) S.A. and the respective Ukrainian authorities. 2.12. Cooperation in the area of climate change Both Sides recognize that climate change is becoming more dangerous and the necessity of directing international efforts to prevent anthropogenic interference becomes more important. In this regard, the Hellenic Republic and Ukraine will make every effort to prevent global temperatures to increase above 2°C through active collaboration on a common position on the future international climate change regime after 2012 in the framework of negotiations on climate change under UN auspices and to exchange experience on the national emission trading market and its future accession to the EU system of emission trading. 2.13. Cooperation in the area of energy efficiency and energy savings Both Sides expressed interest in establishing a regular exchange of relevant information between public institutions and enterprises of the Hellenic Republic and Ukraine about the implementation of standards in energy efficiency, the creation of electrical energy labeling of household indicators and the monitoring of energy balance to promote measures of energy efficiency programs, particularly in carrying out joint actions to create a social conscious attitude about the need for development and the use of renewable energy and alternative fuels.
