Φύλλου 94 18 Απριλίου 2005 ΑΠΟΦΑΣΕΙΣ Έγκριση του Προγράμματος Εκπαιδευτικής, Επιστημονι?κής και Πολιτιστικής Συνεργασίας μεταξύ της Ελληνικής Δημοκρατίας και της Δημοκρατίας της Κροατίας για τα έτη 2004, 2005 και 2006 μετά του συνημμένου Παραρ?τήματος. ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ - ΕΘΝΙΚΗΣ ΠΑΙΔΕΙΑΣ ΚΑΙ ΘΡΗΣΚΕΥΜΑΤΩΝ - ΥΓΕΙΑΣ ΚΑΙ ΚΟΙΝΩΝΙΚΗΣ ΑΛΛΗΛΕΓΓΥΗΣ - ΥΦ. ΠΟΛΙΤΙΣΜΟΥ - ΕΠΙΚΡΑΤΕΙΑΣ Έχοντας υπ’ όψιν:
Τις διατάξεις της Συμφωνίας μεταξύ των Κυβερνήσεων της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δημο?κρατίας της Κροατίας περί συνεργασίας στους τομείς του πολιτισμού, της εκπαίδευσης και της επιστήμης, που υπο?γράφηκε στην Αθήνα στις 10 Μαρτίου 1995 και κυρώθηκε με το Ν. 2493/1997 που δημοσιεύθηκε στο υπ’ αριθμ. 84 Φύλ?λο Εφημερίδος της Κυβέρνησης, τεύχος Α΄, της 16ης Μαΐου 1997.
Το άρθρο δεύτερο του ως άνω κυρωτικού Νόμου σύμ?φωνα με το οποίο τα Πρωτόκολλα-Πρακτικά που καταρτί?ζονται από τη Μεικτή Επιτροπή του άρθρου 19 της Συμφω?νίας αυτής εγκρίνονται με κοινή πράξη των αρμοδίων κατά περίπτωση Υπουργών.
Τις διατάξεις του άρθρου 29 Α΄ του Ν. 1558/1985 (ΦΕΚ Α΄ 137), όπως αυτό συμπληρώθηκε με το άρθρο 27 του Ν. 2081/1992 (ΦΕΚ Α΄ 154) και τροποποιήθηκε με το άρθρο 1 παρ. 2α του Ν. 2469/1997 (ΦΕΚ Α΄ 38).
Το γεγονός ότι εκ του περιεχομένου του υπό έγκριση Προγράμματος δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμ?φωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λο?γιστηρίου του Κράτους.
Την υπ’ αριθμ. 133/24.3.2004 απόφαση του Πρωθυ?πουργού και Υπουργού Πολιτισμού με την οποία ανατέθηκε η άσκηση αρμοδιοτήτων στην Αναπληρωτή Υπουργό Πολι?τισμού Φάνη Πάλλη-Πετραλιά και στους Υφυπουργούς Γιώργο Ορφανό και Πέτρο Τατούλη (ΦΕΚ 527/24.3.2004, τεύχος Β΄ και 558/2.4.2004, τεύχος Β΄).
Το περιεχόμενο του υπό έγκριση Προγράμματος μετά του συνημμένου Παραρτήματος, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρόγραμμα Εκ?παιδευτικής, Επιστημονικής και Πολιτιστικής Συνεργασίας με?ταξύ της Ελληνικής Δημοκρατίας και της Δημοκρατίας της Κροατίας για τα έτη 2004, 2005 και 2006 μετά του συνημμένου Παραρτήματος που υπογράφηκε στην Αθήνα στις 7 Οκτωβρί?ου 2004, του οποίου το κείμενο σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: Η απόφαση αυτή να δημοσιευθεί στην Εφημερίδα της Κυ?βερνήσεως. Αθήνα, 13 Απριλίου 2005 ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ ΕΘΝΙΚΗΣ ΠΑΙΔΕΙΑΣ ΚΑΙ ΘΡΗΣΚΕΥΜΑΤΩΝ Π. ΜΟΛΥΒΙΑΤΗΣ Μ. ΓΙΑΝΝΑΚΟΥ ΥΓΕΙΑΣ ΚΑΙ ΚΟΙΝΩΝΙΚΗΣ ΑΛΛΗΛΕΓΓΥΗΣ ΥΦ. ΠΟΛΙΤΙΣΜΟΥ Ν. ΚΑΚΛΑΜΑΝΗΣ Π. ΤΑΤΟΥΛΗΣ ΕΠΙΚΡΑΤΕΙΑΣ Θ. ΡΟΥΣΟΠΟΥΛΟΣ PROGRAMME FOR EDUCATIONAL, SCIENTIFIC AND CULTURAL CO-OPERATION BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF CROATIA FOR THE YEARS 2004, 2005 AND 2006 The Government of the Hellenic Republic and the Govern?ment of the Republic of Croatia (hereinafter referred to as "the Parties"), desiring to further develop their relations and co?operation in the fields of education, science, culture, mass media, youth and sports and in accordance with the Agree?ment between the Government of the Hellenic Republic and the Government of the Republic of Croatia on Co-operation in the Fields of Culture, Education and Science, signed in Athens, on March 10, 1995, have agreed upon the following Programme for Educational, Scientific and Cultural Co-oper?ation for the years 2004, 2005 and 2006. I. EDUCATION AND SCIENCE Article 1 The Parties shall encourage direct co-operation between their institutions of higher education in accordance with the legislation of each country. Co-operation between schools of primary and secondary education shall also be promoted. Details shall be arranged through diplomatic channels. 1049 agreements between universities. Article 3 The Parties shall exchange, annually, two (2) members of university teaching staff, for a period of up to seven (7) days, to deliver lectures and exchange information. Article 4 The Parties shall co-operate, in order to spread the teach?ing of their language and culture in the other country, espe?cially at their respective universities or other institutions of higher education. Therefore, they will exchange books, ped?agogical and literary works, visits by guest lecturers etc. The Parties note with satisfaction all initiatives, such as the Onassis Foundation programme regarding the teaching of ancient and modern Greek language, culture and civilization in the Republic of Croatia, as well as the participation of Croa?tian pupils at international competitions and theatre perfor?mances in Greece. Article 5 During the validity of this Programme, the Parties shall exchange three (3) experts from primary or secondary ed?ucation or the administration of education, for a period of up to seven (7) days each, with a view to getting informed on subjects of their competence. Article 6 The Parties shall exchange information concerning the ed?ucational system of the other country and the appliance of new technologies in the field of education, upon request of the other Party. Article 7 The Parties shall collaborate towards the objective presen?tation of their History and Geography in the primary and sec?ondary education textbooks, in accordance with the spirit and aims of UNESCO and the Council of Europe and shall, to this end, exchange school textbooks. Article 8 The Parties shall grant, annually, ten (10) months scholar?ship for postgraduate studies or up to ten (10) months for re?search as well as two (2) scholarships for attendance to sum?mer courses of language and culture. Article 9 The Parties shall exchange information and documen?tation in order to facilitate their competent authorities in the recognition and equivalence of school certificates, diplo?mas, degrees and other academic titles, in accordance with the legislation of each country. Article 10 The Parties shall encourage bilateral scientific research projects of common interest in the two countries such as the protection of the Mediterranean, archaeological scientific re?search and studies, agriculture, etc. Article 11 The Parties shall exchange information on technological centres for the transfer of technology. II. ARCHIVES & LIBRARIES Article 12 The Parties shall encourage co-operation between their state archives and libraries in accordance with the legislation of each country. During the validity of the present Programme, the Parties shall exchange one (1) archivist and one (1) librarian, for a period of up to eight (8) days each, in order to get informed on matters of their competence. They shall also exchange documentation and other material concerning archives and libraries. III. ART AND CULTURE Article 13 The Parties shall exchange information and printed materi?al, following request of the other Party, concerning literature, museums, theatre, dance, music, fine arts and festivals. Article 14 The Parties shall exchange three or four (3-4) personalities from various fields of culture (archaeology, museology, con?servation and restoration, literature, folklore etc.), for a peri?od of up to seven (7) days each, in order to exchange infor?mation and experience on matters of their speciality. Article 15 The Parties shall encourage the exchange of archaeological publications among competent authorities of each country. Article 16 The Parties shall organise one art or folklore exhibition. The theme and the time of the exhibition shall be agreed upon through diplomatic channels. Article 17 The Parties shall encourage translation and publication of contemporary literary works of the other country, through di?rect co-operation between their publishing houses. To this end, the Parties shall exchange, during the validity of the present Programme, one (1) publisher or translator for a period of up to seven (7) days. Article 18 The Parties shall encourage the participation of artistic groups in cultural events organised in the other country. Article 19 The Parties shall encourage direct co-operation among competent associations of writers, musicians, fine arts and theatre performers and dancers. Article 20 The Parties shall mutually organise one film week or film days. The relevant details shall be agreed upon through di?rect contact between competent authorities of both coun?tries. Article 21 The Parties shall encourage co-operation between their national film archives with a view to exchanging information and audiovisual material. Article 22 The Parties shall encourage participation at international film festivals organised in the other country. 1050 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) Sports and Physical Education, including exchanges of ath?letes, coaches, sport administrators, experts and sport sci?entists, as well as participation in research programmes, in European Union's initiatives in the field of sports, competitive sports, "sports for all", professional sports etc. The ways of implementation refer to competitions, training camps, seminars, schools of coaching etc. The co-operation shall be implemented between the cen?tral services of the General Secretariat for Sports and its gov?erning bodies of the Hellenic Republic and the Ministry of Sci?ence, Education and Sports of the Republic of Croatia and the Croatian Olympic Committee. Article 24 The Parties welcome the joint efforts of the International Olympic Committee and the General Assembly of the United Nations for the revival of Olympic Truce and its observance during the Olympic Games and beyond. Within this context they welcome the initiative of the Inter?national Olympic Committee and Greece for the establish?ment of an International Olympic Truce Centre in Athens and reaffirm their will to support actively this initiative by diplo?matic, educational, cultural and other appropriate means. V. YOUTH Article 25 The Parties shall encourage co-operation and contacts be?tween youth organisations and institutions of the two coun?tries in cultural and social activities. They shall exchange rel?evant information and experiences, especially on develop?ments taking place in every sector concerning youth and aiming at strengthening youth relations and creation of friendly relationships. VI. MASS MEDIA Article 26 The Parties shall encourage direct co-operation between the state radio and television organisations of the two coun?tries, as well as between their respective official press agen?cies, in order to exchange radio and television programmes and relevant documentation. VII. MISCELLANEOUS Article 27 The Parties shall encourage joint projects in the fields of ed?ucation, science, research, technology, culture, cultural her?itage, mass media, youth and sports, within multilateral or?ganisations such as UNESCO, UNEP, the Council of Europe and the European Union. Article 28 The Ministry of Education of the Hellenic Republic, in order to develop a common certificate for foreign language learn?ing in Greece, has implemented a standardized examination system whose purpose is to measure levels of proficiency in languages other than Greek. This examination system leads to the "State Certificate of Language Proficiency" (Kratiko Pistopiitiko Glossomathias). Article 29 All provisions and activities laid down in this Programme shall be carried out through diplomatic channels and in ac?cordance with the rules and regulations in force in each country. Article 30 The provisions of the present Programme shall not pre?clude the Parties from agreeing, through diplomatic chan?nels, on other arrangements which they may deem desir?able. Article 31 The attached Annex containing general and financial con?ditions of exchanges in accordance with the present Pro?gramme, constitutes an integral part of this Programme. Article 32 The present Programme shall enter into force on the day of its signature and shall remain in force until 31st of December 2006, whereupon it shall be tacitly extended until the signing of a new one. Done and signed in Athens on October 7, 2004, in two orig?inals in the English language. ANNEX I. GENERAL PROVISIONS FOR EDUCATION AND SCIENCE a) Exchange of Individuals The candidates to be exchanged within the provisions of this Programme shall be nominated by the sending Party which shall notify the receiving Party three (3) months before the candidates' proposed departure date. The sending Party shall present to the receiving Party personal particulars informing about specialisation, profes?sional qualifications, academic titles, languages spoken (English, French or the language of the host country), pro?gramme and duration of stay of the persons to be ex?changed, as well as other useful information. The receiving Party shall notify the sending Party of its con?sent at least one (1) month prior to the proposed date of visit. Upon the receipt of the consent of the receiving Party, the sending Party shall communicate the exact date of departure at least 15 days in advance. b) Exchange of Scholarships
The sending Party shall forward to the receiving Party the candidates' files not later than March 31st and for the year 2004 not later than May 15th.
The candidates' files must contain: • curriculum vitae • copies of study diplomas (certified) • programme of planned studies or research. • health certificate All the above mentioned documents should be translated in the language of the receiving country or English or French.
The receiving Party shall announce the definite accep?tance of the scholarship holders not later than June 30th. ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 1051 of the receiving country, if required for the course. c) Summer Courses The sending Party shall forward to the receiving Party the candidates' files not later than March 31st and for the year 2004 not later than April 30th. The receiving Party shall an?nounce its final acceptance of the candidates not later than May 31st. As far as summer courses candidates are concerned, ele?mentary knowledge of the language and culture of the re?ceiving country is indispensable. In the end of the seminar, scholars must deliver a written report concerning their stay to both authorities. II. FINANCIAL PROVISIONS FOR EDUCATION, SCIENCE, LIBRARIES AND ARCHIVES a) Exchange of Individuals
The sending Party shall cover the cost of travelling fare for scientists, delegations etc., sent under this Programme, to the receiving country's capital and back.
The Croatian Party shall provide: • hotel accommodation and daily allowances in accor?dance with the national legislation, • travel expenses within Croatian territory in accordance with the programme of stay.
The Greek Party shall provide: • 90 euro daily for hotel accommodation and allowance, • travel expenses within Greek territory if they result from the programme of stay, • cost for a one or two day (1-2) visit to archaeological or historical sites.
In case of emergency, medical assistance in public hos?pitals and public medical centres free of charge shall be provided by the receiving Party for persons arriving under provisions of this Programme. b) Exchange of Scholarships
Greek scholars themselves shall provide round trip transportation between the two countries. The Croatian Party shall cover round trip transportation of Croatian scholars be?tween the two countries.
The Croatian Party shall provide: • accommodation in double rooms in students' dor?mitories • food in students' restaurants • a monthly allowance of 50 euro for personal needs • exemption from tuition fees.
The Greek Party shall provide: • a monthly allowance of 440 euro for post-graduate stu?dents or researchers beginning with the student's arrival to Greece and covering the duration of the scholarship • a lump sum of 59 euro upon arrival for accommodation fees for those settling in Athens or of 88 euro for those in the provinces. Students whose scholarship has been renewed are not entitled to this sum • exemption from tuition fees • travel expenses within Greek territory, according to the approved programme of studies of post-graduate students or researchers up to the sum of 88 euro.
In case of emergency, medical assistance in public hos?pitals and public medical centres free of charge shall be provided by the receiving Party for persons arriving under the provisions of this Programme. c) Summer Courses
The scholars themselves shall provide round trip trans?portation between the two countries.
