In section 27A (collection of data on additional support needs), for subsection (1) substitute—
(1) The Scottish Ministers must each year collect from each education authority such information as is specified in regulations made by the Scottish Ministers relating to children and young persons having additional support needs for whose school education the authority is responsible. (1A) Before making regulations under subsection (1), the Scottish Ministers must consult such persons as they consider appropriate.

In section 29 (interpretation)—
- (a) in subsection (1), after the definition of “Tribunal” insert—
“young person” means a person who— (a) is aged 16 years or over, (b) is a pupil at a school, and (c) has, since attaining the age of 16 years or over, remained a pupil at that or another school.

- (b) in subsection (2), the words “ “young person”” are repealed.

In section 31 (duty to inform in writing or alternative permanent form), after the word “parent”—
- (a) where it first occurs, insert “ , child who has attained the age of 12 years ”, and
- (b) where it second occurs, insert “ , child ”.

After section 31 insert—
(31A) (1) The Scottish Ministers must secure the provision of a support service to be available, on request and free of charge, to children who have attained the age of 12 years and— (a) who wish to exercise, or are considering exercising, relevant rights, or (b) whose parents wish to exercise, or are considering exercising, relevant rights. (2) In this section, “a support service” means a service under which— (a) advice (including legal advice), assistance and information in relation to relevant rights are provided to children mentioned in subsection (1), (b) a person is provided to be present at any discussions with an education authority in relation to the relevant rights of such a child for the purpose of supporting the child (where the child wishes such a person to be present), (c) a person is provided to conduct such discussions (or any part of them), or make representations to an education authority, on behalf of such a child (where the child wishes such a person to be provided), and (d) an advocacy service (within the meaning of subsection (3) of section 14A) is provided to such children (the reference in that subsection to persons mentioned in subsection (2) being read as if such children were mentioned in that subsection). (3) Subsection (4) applies where— (a) a child, or parent, as mentioned in subsection (1) wishes to exercise, or is considering exercising, relevant rights, or (b) some other thing is done, or proposed to be done, under this Act by or in relation to such a child. (4) Any person providing a support service under this section may seek the views of the child as respects— (a) the exercise of the relevant rights, or (b) the doing, or proposed doing, of the thing. (5) In this section, “relevant rights”— (a) in relation to a child who has attained the age of 12 years, means any rights conferred by or under this Act on such children, and includes the right— (i) to receive any document or information, and (ii) to give consent in relation to any matter, and (b) in relation to the parents of such a child, means any rights conferred on the parents by or under this Act.

In schedule 1 (Additional Support Needs Tribunal for Scotland), in paragraph 11(2)—

(fa) seeking the views of children whose parents have made references to a Tribunal under section 18(1) in relation to the children,

- (b) after paragraph (ka) insert—
(kb) enabling a convener of a Tribunal and without holding a hearing to determine specified matters relating to the decision of an education authority as respects— (i) the capacity of a child who has attained the age of 12 years to exercise a right under this Act, or (iii) whether something would adversely affect the wellbeing of a child who has attained the age of 12 years, (kc) the practice and procedure relating to matters that may be determined by a convener alone by virtue of paragraph (kb), (kd) applying (with such modifications as may be specified) section 19(2) to a convener determining a matter by virtue of paragraph (kb) as that section applies to a Tribunal,
, and
- (c) in paragraph (v), after “Tribunal” where it second occurs, insert “ , or a convener alone following a determination mentioned in paragraph (kb). ”.

Functions of Scottish Ministers

- (1) The Scottish Ministers must promote, facilitate and support—
- (a) the provision in schools of—
- (i) Gaelic learner education,
- (ii) Gaelic medium education, and
- (b) the teaching of the Gaelic language in the provision of further education by education authorities.
- (2) The Scottish Ministers must in particular promote, facilitate and support the provision of adequate education resources in the Gaelic language for use in school education by teachers and pupils.
6B
- (1) The Scottish Ministers may by regulations specify the standards and requirements to which an education authority must conform in discharging its functions—
- (a) relating to Gaelic learner education and Gaelic medium education in its provision of school education, and
- (b) relating to the teaching of the Gaelic language in its provision of further education.
- (2) Regulations under subsection (1) may make different provision for different purposes and different areas (including different parts of the area of an education authority).
- (3) In preparing regulations under subsection (1), the Scottish Ministers must consult—
- (a) Bòrd na Gàidhlig,
- (b) education authorities,
- (c) the body known as Comann nam Pàrant (Nàiseanta),
- (d) His Majesty’s Chief Inspector of Education in Scotland,
- (e) the General Teaching Council for Scotland,
- (f) persons with an interest in the promotion of the Gaelic language and Gaelic culture,
- (g) persons with an interest in the publication of books and other resources in the Gaelic language, and
- (h) such other persons as they consider appropriate.
- (4) The Scottish Ministers must publish the results of the consultation undertaken under subsection (3).
6C
- (1) The Scottish Ministers must give guidance to Scottish public authorities relating to—
- (a) Gaelic learner education and Gaelic medium education,
- (b) the teaching of the Gaelic language in the provision of further education by education authorities,
- (c) the development of education mentioned in paragraphs (a) and (b).
- (2) A Scottish public authority having functions relating to education must, to the extent that guidance under subsection (1) relates to those functions, have regard to any guidance given by the Scottish Ministers under subsection (1).
- (3) In preparing guidance under subsection (1), the Scottish Ministers must consult—
- (a) Bòrd na Gàidhlig,
- (b) education authorities,
- (c) the body known as Comann nam Pàrant (Nàiseanta), and
- (d) such other persons as the Scottish Ministers consider appropriate.
- (4) The Scottish Ministers must publish any guidance given under subsection (1).

- (1) When the Scottish Ministers produce any information, guidance or documents in the English language for use in school education by teachers or pupils, they must consider whether also to produce that material in the Gaelic language.
- (2) The Scottish Ministers must, on request from an education authority, consider whether to produce a translation into the Gaelic language of any material of the type mentioned in subsection (1), including material produced before this section came into force.
- (3) In this section, a reference to the Scottish Ministers producing material includes—
- (a) that material being produced, commissioned, procured or funded for or by the Scottish Ministers,
- (b) that material being updated.
6E
- (1) The Scottish Ministers must keep under review the adequacy of education resources in the Gaelic language available for use in school education by teachers and pupils.
- (2) The Scottish Ministers must from time to time prepare and publish a report setting out the steps they consider necessary to address any issues identified by the review.
14A
In exercising its functions under Parts 1 and 2 of the 1980 Act, an education authority must—
- (a) promote, facilitate and support—
- (i) Gaelic learner education,
- (ii) Gaelic medium education, and
- (iii) the teaching of the Gaelic language in its provision of further education,
- (b) have regard to the needs and interests of all pupils and prospective pupils who are receiving, or who wish to receive, Gaelic learner education or Gaelic medium education.
Gaelic education qualifications
16B
- (1) In exercising its function of devising qualifications, Qualifications Scotland must ensure that these qualifications include an appropriate number and range of qualifications available through the medium of the Gaelic language.
- (2) In deciding what is an appropriate number and range of qualifications for the purpose of subsection (1), Qualifications Scotland must—
- (a) seek advice from—
- (i) the Scottish Ministers,
- (ii) Bòrd na Gàidhlig,
- (iii) such other persons with expertise or an interest in the Gaelic language as Qualifications Scotland considers appropriate,
- (b) have regard to—
- (i) any advice received in response to a request under paragraph (a),
- (ii) any information Qualifications Scotland has about the demand for qualifications in particular subjects or at particular levels.
16C
- (1) When Qualifications Scotland produces information, guidance or documents in the English language for use in connection with qualifications it has devised, it must also produce equivalent material in the Gaelic language for such of those qualifications as are available through the medium of the Gaelic language.
- (2) Qualifications Scotland must, on request from the Scottish Ministers, produce a translation into the Gaelic language of any material of the type mentioned in subsection (1), whether or not that material was produced before this section came into force.
