Coming into operation: 8th January 1997

Now therefore the said Department concerned, in exercise of the powers conferred by Articles 15(1) and (3), 16(1), 18(1), 25, 26(3) and 47(2) of the Food Safety (Northern Ireland) Order 1991[^f00001] and of every other power enabling it in that behalf, and after consultation, in accordance with Article 47(3) of that Order, with such organisations that appear to it to be representative of interests substantially affected by the Regulations, hereby makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Specified Bovine Material (Treatment and Disposal) (No. 3) (Amendment) Regulations (Northern Ireland) 1996 and shall come into operation on 8th January 1997.

Amendment to the Specified Bovine Material (Treatment and Disposal (No. 3) Regulations (Northern Ireland) 1996

In regulation 2(1) of the Specified Bovine Material (Treatment and Disposal) (No. 3) Regulations (Northern Ireland) 1996[^f00002] for the definition of “scheme animal” there shall be substituted the following definition—

  • “scheme animal” means a bovine animal— which has been slaughtered pursuant to the purchase, slaughter and disposal scheme introduced under Commission Regulation (EC) No. 716/96[^f00003] adopting exceptional support measures for the beef market in the United Kingdom; or which, being an animal which has been exposed to the infection of bovine spongiform encephalopathy, the Department has caused to be slaughtered in accordance with the provisions of paragraph 10A of Part I of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981[^f00004].

Explanatory note

(This note is not part of the Regulations.)

These Regulations amend the definition of “scheme animal” in regulation 2(1) of the Specified Bovine Material (Treatment and Disposal) (No. 3) Regulations (Northern Ireland) 1996 with the effect that various requirements of those regulations requiring the separation of specified bovine material and other animal parts, which are already disapplied in relation to the carcases of animals slaughtered pursuant to the purchase, slaughter and disposal scheme introduced under Commission Regulation (EC) No. 716/96, are now similarly disapplied in relation to the carcases of animals slaughtered in accordance with the provisions of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981 as animals exposed to the infection of bovine spongiform encephalopathy.
