The Waste and Contaminated Land (1997 Order) (Commencement No. 1) Order (Northern Ireland) 1998

The Department of the Environment, in exercise of the powers conferred on it by Article 1(2) of the Waste and Contaminated Land (Northern Ireland) Order 1997[^f00001] and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974[^f00002] and of every other power enabling it in that behalf, hereby makes the following order:

This order may be cited as the Waste and Contaminated Land (1997 Order) (Commencement No. 1) Order (Northern Ireland) 1998.

Appointed Day

The following provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997 shall come into operation on 17th September 1998—

• Article 1,

• Article 2(1), (2) (in so far as it relates to the definitions of “controlled waste”, “the Department”, “disposal”, “household waste” and “regulations”), (3), (7), (8),

• Article 5 (in so far as it relates to the definition of “broker”),

• Article 30,

• Article 44 (in so far as it relates to the Department),

• Article 48,

• Article 76,

• Articles 78 to 82,

• Paragraph 4 of Schedule 5 and Article 83(1) in so far as it relates to it,

• The following repeal in Schedule 6 and Article 83(2) in so far as it relates to it—

• Article 17 of the Pollution Control and Local Government (Northern Ireland) Order 1978[^f00003].

Explanatory note

(This note is not part of the Order.)

This order brings into operation on 17th September 1998 Articles 30 and 48 of the Waste and Contaminated Land (Northern Ireland) Order 1997 (“the Order”) which enable the Department of the Environment to make regulations dealing respectively with special provisions with respect to certain dangerous or intractable substances and with the application of the Order to radioactive waste within the meaning of the Radioactive Substances Act 1993.

The order also brings into operation other ancillary provisions of the Order.
