The Pensions (2005 Order) (Commencement No. 14) Order (Northern Ireland) 2010
Made: 12th March 2010
The Department for Social Development makes the following Order in exercise of the powers conferred by Article 1(2) of the Pensions (Northern Ireland) Order 2005[^f00001].
Citation and interpretation

- (1) This Order may be cited as the Pensions (2005 Order) (Commencement No. 14) Order (Northern Ireland) 2010.
- (2) In this Order “the Order” means the Pensions (Northern Ireland) Order 2005.
Appointed days

- (1) The day appointed for the coming into operation of Article 170 of the Order (Board’s powers to make fraud compensation transfer payments)—
- (a) for the purpose only of authorising the making of regulations, is 15th March 2010, and
- (b) for all other purposes, is 6th April 2010.
- (2) The day appointed for the coming into operation of paragraphs 27 and 28 of Schedule 8 to the Order (reviewable matters) is 6th April 2010.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order makes provision for the coming into operation of the following provisions of the Pensions (Northern Ireland) Order 2005—
- Article 170, for the purpose only of authorising the making of regulations, on 15th March 2010; and for all other purposes, on 6th April 2010; and
- paragraphs 27 and 28 of Schedule 8, on 6th April 2010.
The provisions brought into operation concern the operation of the Fraud Compensation Fund, a statutory fund established by section 188 of the Pensions Act 2004 (c. 35). The provisions deal, in particular, with the making of transfer payments from that fund into the Pension Protection Fund, a separate statutory fund established by section 173 of that Act.
