The Department for Social Development makes the following Regulations in exercise of the powers conferred by sections 113(1)(a) and 171(1) and (3) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992[^f00001] and now vested in it[^f00002].

Citation and commencement

These Regulations may be cited as the Social Security Benefit (Persons Abroad) (Amendment) Regulations (Northern Ireland) 2010 and shall come into operation on 6th April 2010.

Amendment of the Social Security Benefit (Persons Abroad) Regulations

  • “the other party” in the case of a person who has been married or in a civil partnership more than once, refers to the person by virtue of whose contributions that person is entitled to the benefit in question;

(ba) in the case of a married person or civil partner entitled to a Category B retirement pension under section 48A of the Contributions and Benefits Act[^f00016] (Category B retirement pension for married persons or civil partners), other than a case that falls within sub-paragraphs (a) to (b) above, any additional Category B retirement pension where immediately before the appointed date that person’s spouse or civil partner was not ordinarily resident in Northern Ireland;

Explanatory note

EXPLANATORY NOTE

These Regulations amend the Social Security Benefit (Persons Abroad) Regulations (Northern Ireland) 1978 (“the Persons Abroad Regulations”).

In regulation 2—

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
