The County Court (Amendment No. 2) Rules (Northern Ireland) 2011

Made: 11th March 2011

Coming into operation: 2nd May 2011

The County Court Rules Committee makes the following Rules in exercise of the powers conferred by Article 47 of the County Courts (Northern Ireland) Order 1980[^f00001].

Citation, commencement and interpretation

These Rules may be cited as the County Court (Amendment No.2) Rules (Northern Ireland) 2011 and shall come into operation on 2nd May 2011.

In these Rules, a reference to an Order, rule, Appendix or Form is a reference to that Order, rule, Appendix or Form so numbered in the County Court Rules (Northern Ireland) 1981[^f00002].

Amendments to the County Court Rules (Northern Ireland) 1981

The County Court Rules (Northern Ireland) 1981 are amended as follows—

• (1) In Order 26, rule 3(1) for “£2000” substitute “£3,000”.

• (2) In Order 55, rule 19—

• (a) in paragraph (1)(b) for “£2,000” substitute “£3,000”;

• (b) in paragraph (2) for “£2,000” substitute “£3,000”.

• (3) In Appendix 1, in Form 10A for “£2,000” substitute “£3,000”.

Saving

Nothing in these Rules shall affect any proceedings which are pending immediately before these Rules come into operation and the Rules in operation before that date shall continue to apply to those proceedings.

Explanatory note

EXPLANATORY NOTE

These Rules amend the County Court Rules (Northern Ireland) 1981 (S.R. 1981 No. 225) to take account of the increase in the small claims court jurisdiction from £2000 to £3000.
