Coming into operation: 25th June 2011

The Department of the Environment, being a department designated[^f00001] for the purposes of section 2(2) of the European Communities Act 1972[^f00002] in relation to the environment, in exercise of the powers conferred upon it by that section, makes the following Regulations.

Amendment of the Groundwater Regulations (Northern Ireland) 2009

(i) the injection of carbon dioxide streams for storage purposes into geological formations which for natural reasons are permanently unsuitable for other purposes, provided that such injection is made in accordance with Directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the geological storage of carbon dioxide[^f00005] or excluded from the scope of that Directive pursuant to its Article 2(2).

EXPLANATORY NOTE

These Regulations amend regulation 16 of the Groundwater Regulations (Northern Ireland) 2009 to allow the storage of carbon dioxide in geological formations which for natural reasons are permanently unsuitable for other purposes.
