The HIV Testing Kits and Services (Revocation) Regulations (Northern Ireland) 2015

Coming into operation: 29th January 2016

The Department of Health, Social Services and Public Safety makes the following Regulations, in exercise of the powers conferred by Article 12(1) of the Health and Medicines (Northern Ireland) Order 1988[^f00001].

Citation and commencement

These Regulations may be cited as the HIV Testing Kits and Services (Revocation) Regulations (Northern Ireland) 2015 and come into operation on 29th January 2016.

Revocation

The HIV Testing Kits and Services Regulations (Northern Ireland) 1992[^f00002] are revoked.

EXPLANATORY NOTE

type=start slip=2016-01-01 time=1452161591043These Regulations revoke the HIV Testing Kits and Services Regulations (Northern Ireland) 1992 (the “1992 Regulations”) in relation to Northern Ireland only. The 1992 Regulations make it an offence, subject to various exceptions:type=end slip=2016-01-01 time=1452161591043

• to sell or supply an HIV testing kit or component to a member of the public;

• to sell or supply an HIV testing kit without an accompanying warning notice; and

• to provide HIV testing services which are not directed by a registered medical practitioner (Regulation 4).

In addition, Regulation 5 places restrictions on advertisements for such kits, components and services.
