The Department for Social Development makes the following Order in exercise of the power conferred by section 41(1) of the Child Maintenance Act (Northern Ireland) 2008[^f00001].

This Order may be cited as the Child Maintenance (2008 Act) (Commencement No. 15) Order (Northern Ireland) 2015.

Appointed day

Section 31 of the Child Maintenance Act (Northern Ireland) 2008 (disclosure of information to credit reference agencies) comes into operation on—

(a) the day after the day on which this Order is made for the purpose only of making regulations; and

(b) 23rd March 2015 for all other purposes.

Explanatory note

EXPLANATORY NOTE

This Order provides for the coming into operation of section 31 of the Child Maintenance Act (Northern Ireland) 2008, on the day after the day on which this Order is made for the purpose of making of regulations and on 23rd March 2015 for all other purposes. Section 31 inserts new Article 45D into the Child Support (Northern Ireland) Order 1991. Article 45D allows the Department to disclose information relating to persons who are liable to pay Child Support Maintenance to credit reference agencies. It will only allow the Department to disclose information relating to such a person where that person has given their consent to the disclosure or is subject to a liability order. Article 45D enables the Department to make regulations prescribing the information that may be disclosed.
