The Department for Employment and Learning makes the following Regulations in exercise of the powers conferred by section 167ZZ8(1) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992[^f00001].

Citation and commencement

These Regulations may be cited as the Social Security Contributions and Benefits (Northern Ireland) Act 1992 (Application of Parts 12ZA and 12ZB to Adoptions from Overseas) (Amendment) Regulations (Northern Ireland) 2015 and come into operation on 15th March 2015.

Amendments to the Social Security Contributions and Benefits (Northern Ireland) Act 1992 (Application of Parts 12ZA and 12ZB to Adoptions from Overseas) (Northern Ireland) Regulations 2003

The Social Security Contributions and Benefits (Northern Ireland) Act 1992 (Application of Parts 12ZA and 12ZB to Adoptions from Overseas) Regulations (Northern Ireland) 2003[^f00002] are amended as follows.

In the title, for “and 12ZB” substitute “, 12ZB and 12ZC”.

In regulation 1(1), for “and 12ZB” substitute “, 12ZB and 12ZC”.

After regulation 3 insert—

(4) Part 12ZC of the Act shall apply in relation to adoptions from overseas, with the modifications of sections 167ZW and 167ZX of the Act[^f00003] specified in the second column of Schedule 3.

After Schedule 2, insert new Schedule 3 contained in the Schedule to these Regulations.

Explanatory note

EXPLANATORY NOTE

These Regulations amend the Social Security Contributions and Benefits (Northern Ireland) Act 1992 (Application of Parts 12ZA and 12ZB to Adoptions from Overseas) Regulations (Northern Ireland) 2003. The amendments made by these Regulations apply Part 12ZC (Statutory Shared Parental Pay) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992, as modified by these Regulations, to adoptions from overseas, which are adoptions of children who enter Northern Ireland from outside the United Kingdom in connection with, or for the purposes of, adoption which does not involve the placement of a child for adoption under the law of any part of the United Kingdom.

An impact assessment has not been prepared for these Regulations. These Regulations are part of a package of legislative measures and the relevant impacts were assessed within the document ‘Sharing parental rights, extending flexibility at work – public consultation’, published in May 2013 (www.delni.gov.uk/index/consultation-zone/archived-consultations/archived-consultations-2013/working-parents-rights.htm), and supplemented by a further publication in April 2014 (http://www.delni.gov.uk/index/publications/equality-good-relations/shared-parental-leave-and-pay.htm).
