The Disabled Persons (Badges for Motor Vehicles) (Amendment) Regulations (Northern Ireland) 2016

Coming into operation-: 1st April 2016

The Department for Regional Development[^f00001] makes the following Regulations in exercise of the powers conferred by section 14 of the Chronically Sick and Disabled Persons (Northern Ireland) Act 1978[^f00002] and now vested in it[^f00003].

Citation and commencement

These Regulations may be cited as The Disabled Persons (Badges for Motor Vehicles) (Amendment) Regulations (Northern Ireland) 2016 and shall come into operation on 1st April 2016.

Amendments

• (1) The Disabled Persons (Badge for Motor Vehicles) Regulations (Northern Ireland) 1993[^f00004] is amended in accordance with paragraphs (2) to (6).

• (2) In Regulation 2 —

• (a) after the definition of “cycle lane restriction” insert—

• “date of issue” means the date on which a disabled person’s badge is first valid for use.

and

• (b) after the definition of “holder” insert—

• issuing authority” means the Department.
• “local authority” means the Department.

• (3) For Regulation 3 (form of badge) substitute the following—

(3) (1) Paragraph (2) applies in respect of a badge with a date of issue before 1st April 2016 and paragraph (4) applies in respect of a badge with a date of issue on or after that date. (2) A disabled person’s badge issued to— (i) an individual shall be in the form shown in diagram 1 in Part I of the Schedule; or (ii) a support organisation shall be in the form shown in diagram 2 in Part I of the Schedule. (3) The badge mentioned in paragraph (2) shall comply with the specifications set out in Part II of the Schedule. (4) A disabled person’s badge is in the prescribed form if— (a) the front and reverse of the badge are in the form shown in— (i) diagram 1A in Part I of the Schedule in the case of an individual’s badge (with the omission of the word “sample” where it appears); or (ii) diagram 2A in Part I of the Schedule in the case of an organisational badge (with the omission of the word “sample” where it appears); and (b) the badge complies with the specifications in Part III of the Schedule.

• (4) Regulation 3F is revoked.

• (5) In regulation 6 (fee for badge) for “£2” substitute “£10.00”

• (6) In the Schedule—

• (a) in diagram 1 in Part I after the heading “Form of Badge for an Individual”, insert “(with a date of issue before 1st April 2016)”;

• (b) after diagram 1 in Part I, insert the diagram set out in Schedule 1 to these Regulations;

• (c) in diagram 2 in Part I, after the heading “Form of Badge for a Support Organisation”, insert “(with a date of issue before 1st April 2016)”;

• (d) after diagram 2 in Part I, insert the diagram set out in Schedule 2 to these Regulations;

• (e) in Part II (Specifications for Badges), after the heading “Specifications for Badge”, insert “(with a date of issue before 1st April 2016)”; and

• (f) after Part II, insert the provision set out in Schedule 3 to these Regulations.

EXPLANATORY NOTE

These Regulations further amend the Disabled Persons (Badges for Motor Vehicles) Regulations (Northern Ireland) 1993 by changing the fee for a disabled person’s badge to £10.00 and by including additional specifications for the form of the badge with effect from 1 April 2016.
