The Food Hygiene Rating (Fee and Fixed Penalty Amount) Order (Northern Ireland) 2016

Coming into operation in accordance with Article 1(1)

The Department of Health[^f00001], in exercise of the powers conferred by sections 4(7)(c) and paragraph 4 of the Schedule to the Food Hygiene Rating Act (Northern Ireland) 2016[^f00002], makes the following Order.

Citation, commencement and interpretation

• (1) This Order may be cited as the Food Hygiene Rating (Fee and Fixed Penalty Amount) Order (Northern Ireland) 2016 and comes into operation forthwith.

• (2) In this Order “the Act” means the Food Hygiene Rating Act (Northern Ireland) 2016

Fee for re-rating

An application made to a district council for a review of a food business establishment’s food hygiene rating under section 4 of the Act must be accompanied by a fee of £150.00.

Amount of fixed penalty

The fixed penalty in respect of an alleged offence under section 10(1) or (2) of the Act is £200.00.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order prescribes the fee to be charged for a review of a food hygiene rating (a re-rating).

This Order also prescribes the amount of fixed penalty payable under a fixed penalty notice served under section 10 (1) or (2) of the Food Hygiene Rating Act (Northern Ireland) 2016.
