The Mental Health Review Tribunal (Amendment) Rules (Northern Ireland) 2016

Made: 18th February 2016

Coming into operation: 10th March 2016

The Department of Justice makes the following Rules in exercise of the powers conferred by Article 83(1) and 83(4) of the Mental Health (Northern Ireland) Order 1986[^f00001] and now vested in the Department of Justice[^f00002] after consultation with the Lord Chief Justice.

Citation and commencement

These Rules may be cited as the Mental Health Review Tribunal (Amendment) Rules (Northern Ireland) 2016 and shall come into operation on 10th March 2016.

Amendments to the Mental Health Review Tribunal (Northern Ireland) Rules 1986

Rule 26(2) of the Mental Health Review Tribunal (Northern Ireland) Rules 1986[^f00003] shall be amended as follows—

• (1) after “circumstances of the case” insert “where in the interests of justice”;

• (2) omit “,with the exception of the periods of notice specified in rule 16(4), rule 20 and rule 25(2),”.

Explanatory note

(This note is not part of the Rules)

EXPLANATORY NOTE

These Rules amend the Mental Health Review Tribunal (Northern Ireland) Rules 1986 (S.R. 1986 No. 193) so as to allow the Tribunal to extend or abridge the time appointed by the Rules for doing any act where in the interests of justice to do so.
