The Scottish Ministers, in exercise of the powers conferred by sections 191 and 192 of the Housing (Scotland) Act 1987[^f00001] and of all other powers enabling them in that behalf, after consultation with such associations of local authorities as appear to them to be concerned in accordance with section 191(3) of that Act, hereby make the following Order, a draft of which has together with a report of the considerations leading to the provisions of the order, been laid before and approved by resolution of the Scottish Parliament in accordance with section 191(9) of that Act.

Aggregate amount of grants for 2003–2004

The aggregate amount of the housing support grants for the year 2003–2004 shall be £9,597,320.

SCHEDULE 2 — ASSESSMENT OF ESTIMATED NET EXPENDITURE OF SCHEDULE 1 LOCAL AUTHORITIES FOR 2003–2004 FOR APPORTIONMENT OF GENERAL PORTION

The estimated net expenditure of a local authority listed in Schedule 1 to this Order for the purposes of apportionment of the general portion shall be the amount arrived at by the addition of the amounts specified in items 2 to 6 below less the amounts specified in items 7 and 8 below.

Estimated loan charges due to be debited to the local authority’s housing revenue account for the year 2003–2004 under paragraph 3(a) of Schedule 15 to the Housing (Scotland) Act 1987 other than loan charges in respect of hostels and lodging houses.

For supervision and management–

For repairs and maintenance, £659.39 multiplied by the number of houses of the authority.

Estimated rents lost because of unlet houses.

Estimated other miscellaneous expenditure which may properly be included in the authority’s housing revenue account.

Income

£2386.01 multiplied by the number of the authority’s houses.

Estimated income other than rental income which may properly be included in the authority’s housing revenue account.

Explanatory note

(This note is not part of the Order)

This Order fixes for the year 2003 2004 the aggregate amount of the housing support grants payable to some local authorities under section 191 of the Housing (Scotland) Act 1987; lists the councils among whom the grants will be apportioned; and prescribes the method of apportionment among those councils of the general and hostel portions of the aggregate amount.

The Order provides (article 3(1)) for the aggregate amount to be divided into general and hostel provisions. Article 3(2) and Schedule 1 prescribe the local authorities among whom the grants for the general portion will be apportioned. Schedule 2 provides the method of calculation. Article 3(3) and Schedule 3 prescribe the local authorities among whom the grants for the hostel portion will be apportioned and the method of calculation.

[^f00001]: 1987 c. 26; sections 191(10) and 192(6) were amended by the Housing (Scotland) Act 1988 (c. 43), Schedule 8, paragraphs 4 and 5 respectively. See section 192(7) of the 1987 Act for the definition of “prescribed”. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). The requirement to obtain Treasury consent was removed by section 55 of that Act.
