Explanatory note

(This note is not part of the Order)

This Order brings into force provisions of the Serious Organised Crime and Police Act 2005 (“the 2005 Act”) which extend the Private Security Industry Act 2001 to Scotland (“the 2001 Act”) and make various amendments to that Act in consequence. This Order commences the amendments in Schedule 15 to the 2005 Act for Scotland on 30th June 2006 and for England and Wales on 6th July 2006.

The 2001 Act is already in force in England and Wales. The amendments made by virtue of this Order shall come into force on the appointed day for England and Wales. However as the 2001 Act is not yet in force in Scotland the amendments made to the 2001 Act by virtue of this Order shall then require to be commenced for Scotland. This will be achieved by a commencement order made under the 2001 Act (SSI 2006/ 382 (C.32)).
