The Lords of Council and Session, under and by virtue of the powers conferred by section32 of the Sheriff Courts (Scotland) Act 1971[^f00001], section5 of the Court of Session Act 1988[^f00002], paragraph37 of Schedule6 to the Scotland Act 1998[^f00003], paragraph38 of Schedule10 to the Northern Ireland Act 1998[^f00004] and paragraph32 of Schedule9 to the Government of Wales Act 2006[^f00005], and under and by virtue of all other powers enabling them in that behalf, having consulted and taken into consideration the views of the Sheriff Court Rules Council in accordance with section33 of the said Act of 1971, do hereby enact and declare:

Explanatory note

(This note is not part of the Act of Sederunt)

EXPLANATORY NOTE

This Act of Sederunt amends Chapter 25A of the Rules of the Court of Session (devolution issues). It also amends the Act of Sederunt (Proceedings for Determination of Devolution Issues Rules) 1999 which applies to devolution proceedings in civil proceedings in the sheriff court. Both are amended in consequence of the establishment of the Supreme Court by the Constitutional Reform Act 2005 and the transfer from the Judicial Committee of the Privy Council to the Supreme Court of jurisdiction in relation to devolution issues arising under the Scotland Act 1998, the Northern Ireland Act 1998 and the Government of Wales Act 2006.
