The Scottish Ministers make the following Order in exercise of the powers conferred by section84(1) of the Animal Health Act 1981[^f00001] and all other powers enabling them to do so.

The fees set out in the Schedule to this Order for inspections in connection with applications for approval of compartments made under the Poultry Compartments (Scotland) Order 2010 must be paid to the Scottish Ministers by the applicant within 30 days of completion of the relevant inspection.

First day or part day of an inspection at an administrative site £1,400 + VAT
Each additional day or part day of an inspection at an administrative site £1,000 + VAT
A production site inspection £1,000 + VAT

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order provides for the payment of fees for inspections in connection with applications for approval of compartments made under the Poultry Compartments (Scotland) Order 2010. That Order implements Commission Regulation (EC) No. 616/2009 (O.J. No. L 181, 14.7.2009, p.16) which makes provision for the approval of poultry compartments which meet certain biosecurity standards.

A regulatory impact assessment has not been prepared for this instrument.

[^f00001]: 1981 c. 22 (“the 1981 Act”). The power to make Orders under this section was originally conferred on “the Ministers” as defined in section 86(1) of the 1981 Act. The functions of the Ministers were, insofar as within devolved competence, transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46) (“the 1998 Act”) and the requirement to obtain Treasury consent under section 84(1) of the 1981 Act was removed by section 55 of the 1998 Act.
