The Scottish Ministers make the following Order in exercise of the powers conferred by section206(1) of the Criminal Justice and Licensing (Scotland) Act 2010[^f00001].

This Order may be cited as the Criminal Justice and Licensing (Scotland) Act 2010 (Commencement No. 1) Order 2010.

Commencement of section 178(3)(e)

The date for the coming into force of section 178(3)(e) of the Criminal Justice and Licensing (Scotland) Act 2010 is 16th August 2010 but only in respect of applications for the grant or renewal of licences under paragraph 6 of Schedule 2 to the Civic Government (Scotland) Act 1982[^f00002] made to the local authority on or after that date.

Explanatory note

EXPLANATORY NOTE

This Order brings into force section 178(3)(e) of the Criminal Justice and Licensing (Scotland) Act 2010 (“the Act”).

Section 178(3)(e) of the Act amends paragraph 9(3)(e) and (f) of Schedule 2 to the Civic Government (Scotland) Act 1982 which includes provision as to when a licence for a sex shop under Schedule 2 cannot be granted. Section 178(3)(e) comes into force on 16th August 2010 in respect of applications for grant or renewal of licences for sex shops under paragraph 6 of Schedule 2 made to the local authority on or after that date.

the Act received Royal Assent on 6th August 2010, and sections 201, 202, 204, 205 and 206 type=start slip=2011-01-01 time=1294758498650came into force the day after Royal Assent, the 7th Augusttype=end slip=2011-01-01 time=1294758498650.
