The Scottish Ministers make the following Order in exercise of the powers conferred by sections100(3)(a) and 275(8) of the Town and Country Planning (Scotland) Act 1997[^f00001] and all other powers enabling them to do so.

Citation and commencement

This Order may be cited as the Town and Country Planning (Limit of Annual Value) (Scotland) Order 2010 and comes into force on 1stApril 2010.

Limit of Annual Value

The amount prescribed for the purposes of section 100(3)(a) of the Town and Country Planning (Scotland) Act 1997 is £30,000.

Revocation

The Town and Country Planning (Limit of Annual Value) (Scotland) Order 2005[^f00002] is revoked.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order prescribes £30,000 as the limit of annual value for the purposes of section 100(3)(a) of the Town and Country Planning (Scotland) Act 1997 (which relates to the circumstances in which authorities may be obliged to purchase interests of owner-occupiers affected by planning proposals) and replaces the limit of £28,000 prescribed by the Town and Country Planning (Limit of Annual Value) (Scotland) Order 2005 (which is revoked).
