The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 12(3) and 17(2B) of the Legal Aid (Scotland) Act 1986[^f00001] and all other powers enabling them to do so.

Citation and commencement

These Regulations may be cited as the Advice and Assistance and Civil Legal Aid (Priority of Debts) (Scotland) Regulations 2010 and come into force on 12th April 2010.

Amendment of the Advice and Assistance (Scotland) Regulations 1996

In regulation 16(2)(b) of the Advice and Assistance (Scotland) Regulations 1996, for “£5,259” substitute “£5,338”[^f00002].

In regulation 33(b) of the Civil Legal Aid (Scotland) Regulations 2002, for “£5,259” substitute “£5,338”[^f00003].

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations make the following changes:—

Those changes only apply in relation to advice and assistance, or as the case may be civil legal aid, applied for on or after 12th April 2010 (regulation 2).

The Advice and Assistance and Civil Legal Aid (Priority of Debts) (Scotland) Regulations 2009, which previously amended the figures increased by these Regulations, are revoked. That revocation does not have effect in relation to advice and assistance and civil legal aid applied for before 12th April 2010 (regulation 5).

Section 17(2B) was inserted by the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990 (c.40), Schedule 8 paragraph 36(6). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
