The Scottish Ministers make the following Order in exercise of the power conferred by section149(2) of the Local Democracy, Economic Development and Construction Act 2009[^f00001].
Citation and commencement

This Order may be cited as the Local Democracy, Economic Development and Construction Act 2009 (Commencement No. 3) (Scotland) Order 2011 and comes into force on 1stNovember 2011.
Day appointed

The day appointed for Part 5 of Schedule 7 (construction contracts) to the Local Democracy, Economic Development and Construction Act 2009 to come into force is 1st November 2011.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order brings into force on 1stNovember 2011 Part 5 of Schedule 7 (construction contracts) to the Local Democracy, Economic Development and Construction Act 2009 (“the 2009 Act”).
Part8 of the 2009 Act amends Part II of the Housing Grants, Construction and Regeneration Act 1996 (c.53) (“the 1996 Act”) which concerns contracts for the carrying out of construction operations. Part 5 of Schedule 7 to the 2009 Act repeals relevant provisions of the 1996 Act linked to amendments made by Part8 of the 2009 Act which is commenced on 1st November 2011.
Part 9 of the 2009 Act came into force on the date of Royal Assent on 12th November 2009.
