The NHS Quality Improvement Scotland (Dissolution) Order 2011

Coming into force: 1st April 2011
The Scottish Ministers make the following Order in exercise of the powers conferred by sections2(1)(b) and 105(6) and (7) of the National Health Service (Scotland) Act 1978[^f00001] and all other powers enabling them to do so.
Citation and commencement

This Order may be cited as the NHS Quality Improvement Scotland (Dissolution) Order 2011 and comes into force on 1stApril 2011.
Dissolution of NHS Quality Improvement Scotland and consequent revocations

- (1) NHS Quality Improvement Scotland[^f00002] is dissolved.
- (2) The enactments in the Schedule to this Order are revoked.

EXPLANATORY NOTE
This Order dissolves the Special Health Board known as NHS Quality Improvement Scotland and revokes the enactments relating to its constitution.

Section2(1)(b) was inserted by the National Health Service and Community Care Act 1990 (c.19), section28(a)(ii) and was amended by the Smoking, Health and Social Care (Scotland) Act 2005 (asp13), Schedule2, paragraph2(2); section105(7), which contains provisions relevant to the making of orders, was amended by the Health Services Act 1980 (c.53), Schedule6, paragraph5(1) and Schedule7, the Health and Social Services and Social Security Adjudications Act 1983 (c.41), Schedule9, paragraph24 and the Health Act 1999 (c.8) (“the 1999 Act”), Schedule4, paragraph60. See section66(1) of the 1999 Act in relation to any provision of that Act being taken to be a pre-commencement enactment within the meaning of the Scotland Act 1998 (c.46) (“the 1998 Act”). The functions of the Secretary of State so far as they are exercisable in Scotland were transferred to the Scottish Ministers by virtue of section53 of the 1998 Act.
