The Scottish Ministers make the following Order in exercise of the powers conferred by section2(2) of the European Communities Act 1972[^f00001] and all other powers enabling them to do so.

Citation and commencement

This Order may be cited as the Brucellosis (Scotland) Amendment Order 2011 and comes into force on 1st April 2011.

Transitional provision

For the purposes of article 7 of the Brucellosis (Scotland) Order 2009 as amended by article2 of this Order, after 1stApril 2011, the first interval of 3months commences—

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends the Brucellosis (Scotland) Order 2009 which implements Council Directive64/432/EEC insofar as it relates to the operation of a monitoring and testing programme for Brucellosis.

Article2(2)(a) changes the interval for milk sampling from monthly to quarterly and article2(2)(b) makes a consequential amendment as a result of the extension to that interval.

Article3 is a transitional provision which confirms the date upon which the first interval of threemonths commences.

A business regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

Section2(2) was amended by the Scotland Act 1998 (c.46), Schedule8, paragraph15(3) (which was amended by section27(4) of the Legislative and Regulatory Reform Act 2006 (c.51) (“2006 Act”)). Section2(2) was also amended by section 27(1)(a) of the 2006 Act and by the European Union (Amendment) Act 2008 (c.7), Schedule, Part1. The functions conferred upon the Minister of the Crown under section2(2) of the 1972 Act, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section53 of the Scotland Act 1998.
