The Road Works (Fixed Penalty) (Scotland) Amendment Regulations 2011

Coming into force: 1st April 2011
The Scottish Ministers make the following Regulations in exercise of the powers conferred by paragraph2 of Schedule6B to the New Roads and Street Works Act 1991[^f00001] and all other powers enabling them to do so.
In accordance with section163A of that Act[^f00002] they have consulted with such— persons considered by them to be representative of the interests of undertakers; road works authorities; and other persons, as they think appropriate.

These Regulations may be cited as the Road Works (Fixed Penalty) (Scotland) Amendment Regulations 2011 and come into force on 1stApril 2011.

In regulation6 (time limit for giving fixed penalty notice) of the Road Works (Fixed Penalty) (Scotland) Regulations 2008[^f00003] for “60” substitute “91”.

EXPLANATORY NOTE
These Regulations provide for an increase in the time period for giving a fixed penalty notice from 60days to 91days under regulation6 of the Road Works (Fixed Penalty) (Scotland) Regulations 2008.
