The HGV Speed Limit (M9/A9 Trunk Road) Regulations 2014

Coming into force: 28th October 2014
In accordance with section 86(8) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
Citation and commencement

These Regulations may be cited as the HGV Speed Limit (M9/A9 Trunk Road) Regulations 2014 and come into force 7 days after the day on which they are made.
Increased speed limit

In Schedule 6 to the Road Traffic Regulation Act 1984 (speed limits for vehicles of certain classes)[^f00002], in Part I after the Table insert—
For a vehicle falling within class 5(2)(b) above, the maximum speed while the vehicle is being driven on a part of the M9/A9 Trunk Road specified in the Schedule to the HGV Speed Limit (M9/A9 Trunk Road) Regulations 2014 is 50 miles per hour (rather than 40 miles per hour as specified in column 3(c) of the Table above).
Specified parts of the M9/A9 Trunk Road

The Schedule to these Regulations specifies the parts of the M9/A9 Trunk Road referred to in Part I of Schedule 6 to the Road Traffic Regulation Act 1984.
SCHEDULE — Specified parts of the M9/A9 Trunk Road
- Luncarty to Pass of Birnam From a point 348 metres or thereby north of the overbridge with the B9099 northwards to a point 752 metres or thereby south of its overbridge with the U116, a distance of 9,118 metres or thereby.
- Birnam to Ballanluig From a point 1,905 metres or thereby south of its northern junction with the B867 northwards to a point 717 metres or thereby south of the overbridge with the A827, a distance of 15,865 metres or thereby.
- Pitlochry to Faskally From a point 160 metres or thereby south of the overbridge at its southern junction with the A924 northwards to a point 15 metres or thereby north of the overbridge at its northern junction with the A924, a distance of 3,810 metres or thereby.
- Faskally to Killiecrankie From a point 390 metres or thereby north of the overbridge at its northern junction with the A924 northwards to a point 1,983 metres or thereby north of the overbridge at its northern junction with the A924, a distance of 1,593 metres or thereby.
- Killiecrankie to Drumochter From a point 3,335 metres or thereby south of its southern junction with the B8079 northwards to a point 1,084 metres or thereby south of its junction with the C454, a distance of 21,601 metres or thereby.
- Dalnaspidal to Crubenmore From a point 371 metres or thereby south of its junction with Dalnaspidal Lodge northwards to a point 6,418 metres or thereby south of its junction with the B9150, a distance of 20,272 metres or thereby.
- Etteridge to Slochd From a point 2,744 metres or thereby south of its junction with the B9150 northwards to a point 382 metres or thereby south of its junction with the U2856, a distance of 48,846 metres or thereby.
- Tomatin to Moy From a point 451 metres or thereby south of its junction to the C1121 northwards to a point 3,908 metres or thereby south of its junction with the B851, a distance of 8,925 metres or thereby.

Explanatory note
(This note is not part of the Regulations)
EXPLANATORY NOTE
These Regulations amend Schedule 6 to the Road Traffic Regulation Act 1984 which sets speed limits in respect of particular classes of vehicle. The speed limit for a heavy goods vehicle falling within class 5(2)(b) in Part I of that Schedule is 40mph, except where the vehicle is being driven on a motorway or dual carriageway. These Regulations increase the speed limit for such a vehicle to 50mph when it is being driven on a single carriageway stretch of the M9/A9 Trunk Road specified in the Schedule to the Regulations. The relevant stretches all lie between Perth and Inverness.
