The Scottish Ministers make the following Order in exercise of the powers conferred by section 145(2) of the Community Empowerment (Scotland) Act 2015[^f00001] and all other powers enabling them to do so[^f00002].
Citation, commencement and interpretation

- (1) This Order may be cited as the Community Empowerment (Scotland) Act 2015 (Commencement No. 5) Order 2016 and comes into force on 16th December 2016.
- (2) In this Order—
- “the 2003 Act” means the Land Reform (Scotland) Act 2003[^f00003];
- “the Act” means the Community Empowerment (Scotland) Act 2015.
Appointed day

- (1) Subject to paragraph (2), the day appointed for the coming into force of the provisions of the Act specified in column 1 of the table in the schedule (the subject matter of which is described in column 2 of that table) is 16th December 2016.
- (2) Where a purpose is specified in column 3 of that table in relation to any provision specified in column 1, that provision comes into force on 16th December 2016 only for that purpose.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order brings into force certain provisions of the Community Empowerment (Scotland) Act 2015 (“the Act”).
Article 2 appoints 16th December 2016 for the coming into force of the provisions of the Act set out in the table in the schedule, for limited purposes where specified. The provisions relate to Ministerial powers to make subordinate legislation.
The Bill for the Act received Royal Assent on 24th July 2015. Sections 141 to 143, 145 and 146 came into force the following day.
