The Scottish Ministers make the following Order in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990[^f00001] and all other powers enabling them to do so.

Variation of section 153(1) of the Environmental Protection Act 1990

In section 153(1) of the Environmental Protection Act 1990[^f00002] (financial assistance for environmental purposes), after paragraph (z1)[^f00003] add—

(z2) any programme of measures to achieve, in relation to a body of water, environmental objectives of the kind that may be set in relation to that body of water under Part 1 of the Water Environment and Water Services (Scotland) Act 2003[^f00004] or (as the case may be) schedule 1 of the Water Environment(WaterFrameworkDirective) (Solway Tweed River Basin District) Regulations 2004[^f00005].

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order varies section 153(1) of the Environmental Protection Act 1990 to add any programme of measures to achieve, in relation to a body of water, environmental objectives of the kind that may be set under Part 1 of the Water Environment and Water Services (Scotland) Act 2003 or schedule 1 of the Water Environment (Water Framework Directive) (Solway Tweed River Basin District) Regulations 2004. This will enable the Scottish Ministers to give financial assistance for the purposes of any such programme of measures.
