The Community Empowerment (Scotland) Act 2015 (Commencement No. 8) Order 2017

The Scottish Ministers make the following Order in exercise of the powers conferred by section 145(2) of the Community Empowerment (Scotland) Act 2015[^f00001] and all other powers enabling them to do so[^f00002].

Citation, commencement and interpretation

• (1) This Order may be cited as the Community Empowerment (Scotland) Act 2015 (Commencement No. 8) Order 2017 and comes into force on 30th June 2017.

• (2) In this Order “the 2003 Act” means the Land Reform (Scotland) Act 2003[^f00003].

Appointed day

30th June 2017 is the day appointed for the coming into force of section 74 (abandoned, neglected and detrimental land) of the Community Empowerment (Scotland) Act 2015, but only for the purposes of making—

• (a) regulations under the following provisions of the 2003 Act:—

• (i) section 97C(4), (5) and (6);

• (ii) section 97D(1), (7), (8) and (9);

• (iii) section 97F(9) and (10);

• (iv) section 97G(5) and (12);

• (v) section 97H(6);

• (vi) section 97J(2), (3), (4), (7) and (8);

• (vii) section 97M(1) and (2);

• (viii) section 97N(1), (2), (3) and (4); and

• (ix) section 97U(6); and

• (b) orders under the following provisions of the 2003 Act:—

• (i) sections 97E(4) and (5); and

• (ii) sections 97T(4).

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order brings into force certain provisions of the Community Empowerment (Scotland) Act 2015 (“the Act”).

Article 2 appoints 30th June 2017 for the coming into force of section 74 of the Act, for limited purposes relating to Ministerial powers to make subordinate legislation.

The Bill for the Act received Royal Assent on 24th July 2015. Sections 141 to 143, 145 and 146 came into force the following day.
