The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 6(2) and (3) of the Seat Belts on School Transport (Scotland) Act 2017[^f00001].

Citation and commencement

These Regulations may be cited as the Seat Belts on School Transport (Scotland) Act 2017 (Commencement) Regulations 2018 and come into force on 1st August 2018.

Interpretation

In these Regulations “the Act” means the Seat Belts on School Transport (Scotland) Act 2017.

Appointed days

(1) Subject to paragraph (2), the day appointed for the coming into force of sections 1, 4 and 5 of the Act is 1st August 2018.

(2) In respect of arrangements to provide a home-to-school transport service for pupils for whom secondary education is provided where—

(a) the service is provided under a contract entered into by or on behalf of a school authority before 18th December 2017; and

(b) the contract as constituted before that date does not require that the motor vehicle used to provide the service has a seat belt fitted to each passenger seat,

the day appointed for the coming into force of section 1 of the Act is 1st August 2021.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations bring into force section 1 (duty to ensure seat belts fitted on dedicated school transport services), section 4 (annual seat belts statement) and section 5 (guidance on wearing of seatbelts) of the Seat Belts on School Transport (Scotland) Act 2017 (“the Act”). Those sections come into force on 1st August 2018, except in respect of arrangements of the type described in regulation 3(2), where the section 1 duty comes into force on 1st August 2021.

The Bill for the Act received Royal Assent on 18th December 2017. Sections 2, 3, 6 and 7 came into force the following day.
