The Secretary of State, in exercise of the powers conferred upon him by section 26 of the Police (Scotland) Act 1967 [^f00001] and of all other powers enabling him in that behalf, after taking into consideration the recommendations made by the Police Negotiating Board for the United Kingdom and furnishing the said Board with a draft of the Regulations in accordance with section 2(1) of the Police Negotiating Board Act 1980 [^f00002], hereby makes the following Regulations:

Citation

These Regulations may be cited as the Police (Scotland) Amendment (No.2) Regulations 1988.

Commencement

These Regulations shall come into force on 1st February 1989 and shall have effect for the purposes of regulation 4 as from 1st July 1987 and from 1st July 1988 and of regulations 5 and 6 as from 1st September 1988.

Interpretation

In these Regulations any reference to “the principal Regulations” is a reference to the Police (Scotland) Regulations 1976 [^f00003].

University scholars

In paragraph 3(2) of Schedule 9 to the principal Regulations (university scholars) there shall be inserted after the words “rate of” and in place of the words “£945 a year” the words “£1,017 a year with effect from 1st July 1987 and the rate of £1,089 a year with effect from 1st July 1988.”.

Scales of pay

In Schedule 3 to the principal Regulations (scales of pay) for Tables A and B there shall be substituted respectively Tables A and B set out in the Schedule to these Regulations, in paragraph 2(2) there shall be inserted after the words “became a constable” the words “on or before 31st August 1988” and after paragraph 2(2) there shall be inserted the following sub-paragraphs:—

(2A) In the case of a constable who first became a constable after 31st August 1988 and after he had attained the age of 22 years, his annual pay during the period which ends on 31st August 1989 shall be £10,512 and during the remainder of the period before he completes 2 years of reckonable service shall be determined in accordance with Table B as if at all times during the latter period he had two years' reckonable service. (2B) In the case of a constable who became a constable after 31st August 1988 and before he had attained the age of 22 years, his annual pay during the period which ends on 31st August 1989 shall be £8,352.

Dog handler’s allowance

In paragraph 1(1) of Schedule 10 to the principal Regulations (dog handler’s allowance) for the sums “£612” and “£831” there shall be substituted the sums “£663” and “£903” respectively.

Revocations

The Regulations specified in column 1 of Schedule 2 to these Regulations are revoked to the extent specified in column 3 of that Schedule.

Explanatory note

(This note is not part of the Regulations)

These Regulations further amend the Police (Scotland) Regulations 1976 (“the principal Regulations”). They come into force on 1st February 1989 and have effect for the purposes of regulation 4 as from 1st July 1987 and 1st July 1988 and of regulations 5 and 6 as from 1st September 1988 (retrospection being authorised by section 26(3) of the Police (Scotland) Act 1967).

Regulation 4 increases from £945 to £1,017 from 1st July 1987 and to £1,089 from 1st July 1988 the supplement payable to an officer of a Scottish police force who takes up residence as a university scholar in London.

Regulations 5 and 6 provide for increases in the rates of pay of police constables, sergeants, inspectors and chief inspectors and in the rates of the dog handler’s allowance.
