The Diseases of Animals (Approved Disinfectants) (Fees) (England) Order 2010

The Secretary of State, in exercise of the powers conferred by section 84(1) of the Animal Health Act 1981[^f00001] and with the approval of the Treasury, makes the following Order.

Title, application and commencement

This Order may be cited as the Diseases of Animals (Approved Disinfectants) (Fees) (England) Order 2010, applies in England and comes into force on 6th April 2010.

Fees for the testing of disinfectants

A person who applies for a disinfectant to be approved under article 3 of the Diseases of Animals (Approved Disinfectants) (England) Order 2007[^f00002] must, when applying, pay to the Secretary of State—

• (a) a fee of £1,770 for administrative services, plus

• (b) the fee for testing for the relevant purpose in the Schedule.

Where Value Added Tax is chargeable in respect of the provision of any service for which a fee is prescribed in Article 2 and the Schedule there is payable in addition to that fee a further fee equivalent to the amount of Value Added Tax.

Revocation

The Diseases of Animals (Approved Disinfectants) (Fees) (England) Order 2009[^f00003] is revoked.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order revokes and replaces the Diseases of Animals (Approved Disinfectants) (Fees) (England) Order 2009 (S.I. 2009/839).

The Order with effect from 6th April 2010 amends the fee for testing for approval for use for—

• (a) diseases of poultry (if one dilution rate is requested) from £990 to £1,040;

• (b) diseases of poultry (if three dilution rates are requested) from £1,340 to £1,400;

• (c) tuberculosis (if one dilution rate is requested) from £1,260 to £1,300;

• (d) tuberculosis (if three dilution rates are requested) from £1,570 to £1,620;

• (e) foot-and-mouth diseases from £1,865 to £1,920;

• (f) swine vesicular disease from £1,865 to £1,920;

• (g) all other instances where there is a legislative requirement to use an approved disinfectant (if one dilution rate is requested) from £690 to £715; and

• (h) all other instances where there is a legislative requirement to use an approved disinfectant (if three dilution rates are requested) from £790 to £815.

The Order also amends the fee for administrative services from £1,715 to £1,770.

The Order provides for the payment of Value Added Tax in addition to the fee amount where Value Added Tax is chargeable.

A full impact assessment has not been produced for this instrument as a minimal impact on the private or voluntary sectors is foreseen.
