The Animal Health (Miscellaneous Revocations) (England and Wales) Order 2015
Made: 4th March 2015
Coming into force: 1st April 2015
The Secretary of State, in relation to England[^f00001], and the Welsh Ministers, in relation to Wales[^f00002], make the following Order in exercise of the powers conferred by sections 1, 8(1), 15(4), 17(1), 23, 25, 28 and 88(2) of the Animal Health Act 1981[^f00003].
Citation, extent and commencement

This Order—
- (a) may be cited as the Animal Health (Miscellaneous Revocations) (England and Wales) Order 2015;
- (b) extends to England and Wales; and
- (c) comes into force on 1st April 2015.
Revocations

The following Orders are revoked—
- (a) the Foot-and-Mouth Disease (Packing Materials) Order of 1925[^f00004];
- (b) the Foot-and-Mouth Disease (Packing Materials)(Amendment) Order of 1926[^f00005];
- (c) the Warble Fly (England and Wales) Order 1982[^f00006];
- (d) the Warble Fly (England and Wales) (Amendment) Order 1985[^f00007];
- (e) the Warble Fly (England and Wales) (Infected Areas) Order 1985[^f00008];
- (f) the Warble Fly (Ascertainment of Infestation) (England and Wales) Order 1985[^f00009];
- (g) the Warble Fly (England and Wales) (Amendment) Order 1987[^f00010];
- (h) the Warble Fly (England and Wales) (Amendment) Order 1989[^f00011].

EXPLANATORY NOTE
This Order revokes six instruments related to warble fly and two related to foot-and-mouth disease which are spent or otherwise superseded.
An impact assessment has not been produced as no impact, or no significant impact, on the private, voluntary or public sectors is foreseen.

[^f00001]: Functions conferred under the Animal Health Act 1981 (“the 1981 Act”) Act on “the Ministers” and “the appropriate Minister” (as defined in section 86 of that Act) were transferred, so far as exercisable by the Secretaries of State for Scotland and Wales, to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 (S.I. 1999/3141) and were then further transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).
[^f00002]: Functions conferred under the 1981 Act on “the Ministers” and “the appropriate Minister” (as defined in section 86 of that Act) were transferred, so far as exercisable in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). Functions of the Secretary of State were transferred, so far as exercisable in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 2004 (S.I. 2004/3044). Those functions, exercisable in relation to Wales by the National Assembly for Wales are now exercisable by the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
[^f00003]: 1981 c. 22; the Orders listed in article 2(a) and (b) of this Order were made under the Diseases of Animals Acts, 1894 to 1925. These Act were consolidated by Diseases of Animals Act 1950 (c.36) (“the 1950 Act”) under which these Orders continue in force (see section 89 of the 1950 Act). The 1981 Act consolidated the 1950 Act with a number of other Acts. Following this consolidation, the Orders listed in article 2(a) and (b) of this Order have effect, by virtue of section 17(2)(b) of the Interpretation Act 1978 (c. 30), as if made under the 1981 Act.
