The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972, as read with paragraph 1A of Schedule 2 to that Act .

The Secretary of State has been designated for the purposes of section 2(2) in respect of matters relating to electronic communications .

These Regulations make provision for a purpose mentioned in section 2(2) and it appears to the Secretary of State that it is expedient for references to the Framework Directive to be construed as references to that instrument as amended from time to time.

These Regulations may be cited as the Communications (Access to Infrastructure) Regulations 2016 and come into force on 31st July 2016.
