The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 61 and 63 of the Coronavirus Act 2020 .

PART 1 — General

Citation, commencement, extent and application

These Regulations may be cited as the Local Government and Police and Crime Commissioner (Coronavirus) (Postponement of Elections and Referendums) (England and Wales) Regulations 2020 and come into force on 7th April 2020.

These Regulations extend to England and Wales.

Regulations 5 to 9 and 11 to 14 apply to England only.

Interpretation

In these Regulations—

PART 2 — Postponement of by-elections

By-elections of councillors of principal areas

the vacancy in the office of councillor is to be filled at the poll at the ordinary election in 2021 and a poll is not to be held to fill the casual vacancy.

By-elections of parish councillors

the vacancy in the office of councillor is to be filled at the poll at the ordinary election in 2021 and a poll is not to be held to fill the casual vacancy.

By-elections of directly elected local authority mayors

the vacancy is to be filled at the ordinary election on that day and a poll is not to be held to fill the casual vacancy.

By-elections of combined authority mayors

the vacancy is to be filled at the ordinary election in 2021 and a poll is not to be held to fill the casual vacancy.

By-elections to the Greater London Authority
