The Representation of the People (Variation of Limits of Candidates’ Election Expenses) (City of London) Order 2024

The Secretary of State, being of the opinion that there has been a change in the value of money since 28th January 2005 justifying the variations made by this Order, makes this Order in exercise of the powers conferred by section 197(3) of the Representation of the People Act 1983[^f00001].

Citation, commencement and extent

• (1) This Order may be cited as the Representation of the People (Variation of Limits of Candidates’ Election Expenses) (City of London) Order 2024 and comes into force on 4th December 2024.

• (2) This Order extends to England and Wales.

In section 197 of the Representation of the People 1983 Act (candidate’s expenses: ward, and liverymen in common hall, elections)—

• (a) in subsection (1)—

• (i) for “£266” substitute “£460”;

• (ii) for “5.2p” substitute “9p”;

• (b) in subsection (2), for “28.3p” substitute “49p”.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order increases the maximum amounts of candidates’ election expenses at a ward election and an election by liverymen in common hall in the City of London.

The increases are such as are justified by the change in the value of money since the last occasion on which those maximum amounts were fixed on 28th January 2005 by the Representation of the People (Variation of Limits of Candidates’ Election Expenses) (City of London) Order 2005 (S.I. 2005/153). The amounts have increased by 74.4% (rounded to 2 decimal places) and then rounded down to the nearest £10 or penny. The extent of the increase reflects the duration of time that has passed since the limits were last increased in 2005.

In the case of a ward election, the maximum amount of a candidate’s election expenses is made up of a fixed amount (expressed in pounds) plus a sum expressed in pence for each elector included in the ward list to be used at the election. In the case of an election by liverymen in common hall, the maximum amount of a candidate’s election expenses is calculated by allowing an amount in pence for every elector on the common hall register to be used at the election.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
