The Secretary of State makes this Order in exercise of the powers conferred by section 188(3) of the Education and Inspections Act 2006[^f00001].

Paragraph 17 of Schedule 2 to the Education and Inspections Act 2006 (effect of referring proposals to adjudicator) comes into force on 27th November 2024.

Explanatory Note
This Order brings paragraph 17 of Schedule 2 to the Education and Inspections Act 2006 (c. 40) into force on 27th November 2024.
Schedule 2 sets out procedures for publication, consideration and implementation of proposals to establish new schools and discontinue existing schools. In many cases decisions about such proposals are made by local authorities, but proposals are sometimes required to be referred to the Schools Adjudicator. Paragraph 17 provides, in summary, that when this happens, the Schools Adjudicator must consider the proposals and, in doing so, is subject to some of the same provisions that apply to local authority decision-makers.
