The Secretary of State makes these Regulations in exercise of the powers conferred by sections 8(3) and (7), 13(2), 24A(2), 39(9)(a) and (b) and 45(1) and (5) of the Housing Act 1988[^f00001].

The Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015[^f00007] are revoked in relation to any private assured tenancy.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations make provision in relation to the forms to be used under the Housing Act 1988 in relation to a private sector assured tenancy.

Regulation 3 prescribes the new forms, set out in the Schedule, which are to apply to any assured tenancy (except an assured tenancy in relation to social housing). In relation to the notice for possession proceedings under section 8 of the Housing Act 1988, the regulation provides for this to be a form published by the Secretary of State (as replaced from time to time) and sets out the requirements in relation to its publication which include the form being available for inspection during normal office hours at the principal offices of the Secretary of State (2 Marsham Street, London, SW1P 4DF).

Regulation 4 revokes the Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015 in relation to any private assured tenancy.

Regulation 5 makes transitional provisions in relation to cases where the existing forms in the Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015 will continue to apply.

Section 8(3) is amended by section 151 of the Housing Act 1996 (c. 52), section 97 of the Anti-social Behaviour, Crime and Policing Act 2014 (c. 12) and section 3 of the Renters’ Rights Act 2025 (c. 26) (“2025 Act”), and subsection (7) is inserted by section 5 of the 2025 Act.
