The Ancient Monuments (Applications for Scheduled Monument Consent) (Welsh Forms and Particulars) Regulations 2001

Coming into force: 1st May 2001
The National Assembly for Wales makes the following Regulations in exercise of the powers conferred by paragraphs 1(1), 2(1) and 2(2) of Schedule 1 to the Ancient Monuments and Archaeological Areas Act 1979[^f00001] as extended by section 26(3) of the Welsh Language Act 1993[^f00002] and now vested in the National Assembly for Wales so far as they relate to Wales[^f00003], and of all other powers enabling it in that behalf.
Citation, commencement and application

- (1) These Regulations may be cited as the Ancient Monuments (Applications for Scheduled Monument Consent) (Welsh Forms and Particulars) Regulations 2001 and shall come into force on 1st May 2001.
- (2) These Regulations apply to Wales.
Interpretation

In these Regulations, “the principal Regulations” means the Ancient Monuments (Applications for Scheduled Monument Consent) Regulations 1981[^f00004].
Prescribed forms

- (1) The form set out in Schedule 1 to these Regulations is hereby the prescribed version in Welsh which may be used instead of the corresponding form in Schedule 1 to the principal Regulations for the purpose set out in regulation 2 of the principal Regulations.
- (2) The forms set out in Part I of Schedule 2 to these Regulations are hereby the prescribed versions in Welsh which may be used instead of the corresponding forms of certificate in Part I of Schedule 2 to the principal Regulations for the purpose set out in regulation 3(1) of the principal Regulations.
- (3) The form set out in Part II of Schedule 2 to these Regulations is hereby the prescribed version in Welsh which may be used instead of the corresponding form in Part II of Schedule 2 to the principal Regulations for the purpose set out in regulation 3(2) of the principal Regulations.

Explanatory note
(This note does not form part of the Regulations)
Schedule 1 to the Ancient Monuments and Arzhaeological Areas Act 1979, confers a power to make regulations to prescribe the forms for use in applications for scheduled monument consent. This power is now exercisable, in relation to Wales, by the National Assembly for Wales.
The Secretary of State for Wales, in conjunction with the Secretary of State for the Environment, prescribed an English version of the forms by The Ancient Monuments (Applications for Scheduled Monument Consent) Regulations 1981 (“the principal Regulations”)
Section 26(3) of the Welsh Language Act 1993 extends the above-mentioned power to enable the Secretary of State (or, in Wales, the National Assembly for Wales) to prescribe separate forms of a document, or separate forms of words, in Welsh and in English and, in the case of a document, a form partly in Welsh and partly in English.
These Regulations prescribe the Welsh version of the relevant forms which may be used in Wales instead of the English version of the forms prescribed by the principal Regulations.
Regulation 3(1) of these Regulations provides for the form set out in Schedule 1 to these Regulations to be the prescribed Welsh version of the Form of Application in Schedule 1 to the principal Regulations.
Regulation 3(2) of these Regulations provides for the forms set out in Part I of Schedule 2 to these Regulations to be the prescribed Welsh version of the Forms of Certificate in Part I of Schedule 2 to the principal Regulations.
Regulation 3(3) of these Regulations provides for the form set out in Part II of Schedule 2 to these Regulations to be the prescribed Welsh version of the Form of Notice in Part II of Schedule 2 to the principal Regulations.
These Regulations apply to Wales.
