The Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2011

Coming into force: 4 February 2011

The Welsh Ministers in exercise of the powers conferred upon the Secretary of State by section 21 of the Clean Air Act 1993[^f00001] and now vested in the Welsh Ministers[^f00002], and being satisfied that the classes of fireplace exempted by this Order can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby make the following Order:

Title, commencement and application

• (1) The title of this Order is the Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2011 and it comes into force on 4 February 2011.

• (2) This Order applies in relation to Wales.

Classes of fireplaces exempted from section 20 of the Clean Air Act 1993

The classes of fireplaces described in the Schedule are, subject to the conditions listed, exempted from the provisions of section 20 of the Clean Air Act 1993 (which prohibits smoke emissions in smoke control areas).

Revocation

The Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2009 (S.I. 2009/3224) (W.278) is revoked.

SCHEDULE — CLASSES OF FIREPLACE WHICH ARE EXEMPT

Explanatory note

(This note is not part of the Order)

Section 20 of the Clean Air Act 1993 (“the 1993 Act”) places a general prohibition on the emission of smoke in smoke control areas.

The Welsh Ministers may, by order made under section 21 of the 1993 Act, exempt specified classes of fireplace from the provisions of section 20, if they are satisfied that such fireplaces can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke.

This Order applies in relation to Wales.

This Order revokes and replaces with amendments the Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2009 (S.I. 2009/3224) (W.278).

Article 2 of the Order exempts the classes of fireplaces listed in the first column of the Schedule to the Order from the provisions of section 20 of the 1993 Act, subject to the conditions in the second column of that Schedule.

A regulatory impact assessment has been prepared in connection with this Order. A copy can be obtained from the Welsh Assembly Government, Cathays Park, Cardiff, CF10 3NQ.
