The Welsh Ministers make the following Regulations in exercise of the powers conferred on them by sections 18(4), 203(9) and (10) of and paragraph 4 of Schedule 3 to the National Health Service (Wales) Act 2006[^f00001].

Amendment of the Public Health Wales National Health Service Trust (Membership and Procedure) Regulations 2009

Where the non-executive director referred to in sub-paragraph (c) of regulation 5(1) ceases to be a member or employee of a voluntary sector organisation in Wales, the Welsh Ministers will terminate his or her appointment as non-executive director.

Explanatory note

(This note is not part of the Regulations)

These Regulations amend the Public Health Wales National Health Service Trust (Membership and Procedure) Regulations 2009 (S.I. 2009/1385 (W.141) by removing the requirement for the non-executive directors to include a person who is an officer of a trade union or other employee representative body representing staff of the Public Health Wales National Health Service Trust.

There are also minor amendments to regulation 1(2) (interpretation), paragraph 2 of Schedule 1,(procedures for appointment of the chair and non-executive directors), and paragraph 2(2) of Schedule 2 (rules as to meetings and proceedings of the Trust).
