The Food Hygiene Rating (Wales) Act 2013 (Commencement No.1) Order 2013

Made: 11 October 2013

The Welsh Ministers make the following Order in exercise of the powers contained in section 27(2) of the Food Hygiene Rating (Wales) Act 2013[^f00001].

Title, application and interpretation

• (1) The title of this Order is the Food Hygiene Rating (Wales) Act 2013(Commencement No.1) Order 2013.

• (2) In this Order, “the Act” (“y Ddeddf”) means the Food Hygiene Rating (Wales) Act 2013.

Provisions coming into force on 28 October 2013

The appointed day for the following provisions of the Act coming in to force for the purpose of making regulations is 28 October 2013—

• (a) section 3(2), (3)(c) and (d) and (5);

• (b) section 5(4) and (10)(d);

• (c) section 6(2) and (3);

• (d) section 7(3) and (4);

• (e) section 12(2) and (9)(d); and

• (f) section 15(1).

Provisions coming into force on 28 November 2013

The appointed day for the following provisions of the Act coming in to force is 28 November 2013—

• (a) section 1;

• (b) section 2, except for paragraph (b) of subsection (5);

• (c) section 3, for remaining purposes;

• (d) section 4;

• (e) sections 5, 6 and 7, for remaining purposes;

• (f) sections 8 to 11;

• (g) section 12, for remaining purposes;

• (h) sections 13 and 14;

• (i) section 15; for remaining purposes;

• (j) sections 16 to 26;

• (k) section 28; and

• (l) the Schedule.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order is the first commencement order made by the Welsh Ministers under the Food Hygiene Rating (Wales) Act 2013 (“the Act”).

Article 2 brings certain provisions of the Act into force on 28 October 2013 for the purpose of making regulations.

Article 3 brings the provisions mentioned in article 2 into force on 28 November 2013 for all other purposes, and brings all other provisions of the Act not yet in force into force on that date except for subsection 2(5)(b) (which extends the definition of “food business establishment” to include an establishment that supplies food to another business).
